AUTHORIZING THE MAYOR TO ENTER INTO A NEW
REIMBURSEMENT AGREEMENT WITH TRI-TREND,
INC FOR REIMBURSEMENT OF A WATER LINE
WHEREAS, on October 16, 1981, Tri -Trend, Inc. , entered into a Reimbursement
Agreement with the City of Fort Collins for repayment of a portion of the cost
of installation of a certain water main shown on the drawings in File #C3-708
"Rossborough 1st filing" ("the Original Reimbursement Agreement") ; and
WHEREAS, unless extended as permitted by Section 26-372(e) of the Code of
the City of Fort Collins, the term of the Original Reimbursement Agreement shall
expire on October 16, 1991 ; and
WHEREAS, Tri -Trend, Inc. , has requested an extension of the term of the
Original Reimbursement Agreement prior to its expiration pursuant to Section 26-
372(e) ; and
WHEREAS, extension of the Original Reimbursement Agreement is necessary
for continued repayment to Tri-Trend, Inc; and
WHEREAS, if the term of the Original Reimbursement Agreement is extended
as requested by Tri -Trend, Inc. , it is in the best interests of the City that
such an extension be conditioned upon Tri -Trend entering into a new Reimbursement
Agreement with the City, provided that the new Reimbursement Agreement is upon
such terms and conditions as are acceptable to the City Manager and City
Attorney.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the Mayor be, and hereby is, authorized to enter into a new Reimbursement
Agreement with Tri -Trend, Inc. , extending the term of the Original Reimbursement
Agreement until October 16, 2001, upon such terms and conditions as are
acceptable to the City Manager and City Attorney.
Passed and adopted at a regular meeting of the City Council held this 15th
day of October, A.D. 1991.
