OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL
AGREEMENT WITH THE BOARD OF EDUCATION OF POUDRE SCHOOL
DISTRICT R-1 REGARDING SITE IMPROVEMENTS AT
PUTNAM ELEMENTARY SCHOOL
WHEREAS, the Board of Education of Poudre School District R-1, through its
representatives, requested the City's financial participation in improving the
play fields at Putnam Elementary School ("the School ") in exchange for allowing
use of this site by the public as a neighborhood park to the extent such use does
not interfere with the School 's use of the property; and
WHEREAS, the City is willing to participate financially with the site
improvements, consisting of turf improvements and the repair or replacement of
playground equipment for the play fields so that the site may be used as a
neighborhood park; and
WHEREAS, the $12,000 in funds representing the City's financial
contribution for the improvements is available in the Park Equipment Replacement
Account; and
WHEREAS, Section 29-1-203, C.R.S. , authorizes governmental entities to
cooperate and contract with one another in order to provide any function, service
or facility lawfully authorized to each; and
WHEREAS, Article II, Section 16 of the Charter of the City of Fort Collins
also authorizes the Council , by ordinance or resolution, to enter into contracts
with other governmental bodies to furnish governmental services or enter into
cooperative or joint activities with other governmental bodies.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the Mayor be, and hereby is, authorized to enter into an intergovernmental
agreement between the City and the Board of Education of Poudre School District
R-1 , whereby the City will contribute Twelve Thousand Dollars ($12,000. ) for turf
improvement and the repair or replacement of playground equipment for the play
fields, provided that the play fields shall be open for use by the public as a
neighborhood park to the extent such use does not interfere with the School 's
reasonable use of the property.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 1st day of October, A.D. 1991 .
