HomeMy WebLinkAbout1991-122-09/03/1991-BILL OF RIGHTS AMENDMENT OMNIBUS CRIME BILL POLICE OFFICERS SB S.1241 RESOLUTION 91-122 OF THE COUNCIL OF THE CITY OF FORT COLLINS CONCERNING THE POLICE OFFICERS' BILL OF RIGHTS AMENDMENT TO U.S. SENATE BILL S. 1241, THE OMNIBUS CRIME BILL WHEREAS, the U.S. Senate has adopted S. 1241, the Omnibus Crime Bill , which includes a program that would preempt state and local laws and mandate states to impose a Police Officers' Bill of Rights establishing federal standards for conducting internal investigations by municipal law enforcement agencies and for defining police officers rights to sue cities in state courts for monetary damage and other judicial relief, including full reinstatement if these new federally mandated rights were found to be violated; and WHEREAS, Police Services' policy currently includes the vast majority of protections being legislated; and WHEREAS, additional provisions included in the Bill would restrict the ability of the Chief of Police to investigate allegations of police misconduct or use of excessive force; and WHEREAS, Police Services' policy pertaining to administrative investigations is being further reviewed to assure community confidence in the procedure; and WHEREAS, a federal Police Officers' Bill of Rights would impose the will of the federal government into what is clearly a local matter and extend additional rights to police officers which are not available to other City employees. NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Council opposes the imposition upon state and local governments of a federally mandated Police Officers' Bill of Rights.
