OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY TO PARTICIPATE IN THE COST
OF SCHOOL DISTRICT BOUNDARY CHANGE ELECTIONS
WHEREAS, the existing boundaries between the Poudre R-1 and Thompson R2-J
School Districts ("the School Districts") are not consistent with the
southernmost boundary of the City of Fort Collins, which inconsistency results
in a certain amount of confusion and inefficiency in the delivery of services
by the City and the School Districts; and
WHEREAS, a change in the School Districts' common boundary would be
beneficial to the citizens of the City of Fort Collins; and
WHEREAS, in order to accomplish such a boundary change, the School Districts
would be required to hold an election concerning the annexation and detachment
of territory and an election concerning the assumption of a portion of the
Districts' outstanding bonded indebtedness; and
WHEREAS, the City Council believes that it may be in the best interests of
the City to participate in the cost of such elections, so long as the amount paid
by the City represents an equitable share of the total costs of the elections;
and
WHEREAS, Article II, Section 16 of the City Charter and Section 29-1-203,
C.R.S. , provide that the Council may enter into cooperative or joint activities
with other governmental bodies.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the Mayor be, and hereby is, authorized to enter into an intergovernmental
agreement with the Poudre R-1 School District, whereby the City would contribute
up to Five Thousand Dollars ($5,000) to defray the cost of the above-mentioned
elections of the School Districts; provided, however, that: (1) the Mayor and
the City Manager determine that the amount to be paid by the City would represent
an equitable share of the total cost of the elections, and (2) no portion of
said funds shall be utilized to urge electors to vote in favor of or against the
proposed boundary change.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 19th day of March, A.D. 1991 .
