RESOLUTION 95-11 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT WITH THE COLORADO STATE DEPARTMENT OF TRANSPORTATION FOR THE PURPOSE OF CONSTRUCTING A TRAFFIC SIGNAL AT THE INTERSECTION OF U.S. HIGHWAY 287 AND FOSSIL CREEK PARKWAY WHEREAS, the Colorado State Department of Transportation ("CDOT"), in cooperation with the City,has identified the need for a traffic signal at the intersection of U.S. Highway 287 and Fossil Creek Parkway (the "Project"); and WHEREAS,the City builds,operates and maintains all traffic signals within the Fort Collins urban area; and WHEREAS, because of the City's experience in constructing traffic signals, the CDOT has requested that the City participate in said project by serving as the contractor for the construction of the Project; and WHEREAS,the City has submitted to the CDOT the initial design and cost estimates for the Project, which estimates have been accepted by the CDOT; and WHEREAS,the City has estimated that the total cost of the Project will not exceed $50,000 and the City is prepared to proceed with the Project with the understanding that all costs will be reimbursed by the CDOT up to $50,000; and WHEREAS, funds have been budgeted, appropriated and otherwise made available in the sum of$50,000 for the City to construct the Project; and WHEREAS, the Council of the City of Fort Collins does hereby determine that it is in the best interests of the City that said Intergovernmental Agreement be executed between the City and the CDOT; and WHEREAS, Article III, Section 16 of the City Charter provides that the Council may enter into agreements with other governmental bodies for the performance of cooperative or joint activities. NOW THEREFORE BE IT RESOLVED, BY THE COUNCIL OF THE CITY OF FORT COLLINS, that the Mayor be, and hereby is, authorized to enter into an Intergovernmental Agreement between the City and the Department of Transportation of file State of Colorado, for the purpose of constructing a traffic signal at the intersection of U.S. Highway 287 and Fossil Creek Parkway,upon the condition that the cost of the Project,up to the estimated amount of$50,000,will be reimbursed by the Colorado Department of Transportation. Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 7th day of February, A.D. 1995. or � ATTEST: City Clerk
