OF THE COUNCIL OF THE CITY OF FORT COLLINS
ADOPTING AND APPROVING THE BESSETT RESERVATION
PLAT, RESERVING THE LANDS DESCRIBED THEREIN FOR
FUTURE ACQUISITION FOR PUBLIC STREET PURPOSES,
APPOINTING A BOARD OF APPRAISERS AND FIXIN
THE TIME AND PLACE OF MEETING FOR THE
HEARING BY SAID BOARD OF APPRAISERS
WHEREAS, on November 10, 1988, the Planning a Zoning Board approved
and adopted the Bessett Reservation Plat, which P at shows the location of
the lines of a street anticipated to be laid upon the lands described
thereon; and
WHEREAS, said Board did further rec mend to the Council that the
lands described upon said Bessett Reserva ion Plat be reserved for future
acquisition for public street purposes u it December 31, 1993; and
WHEREAS, pursuant to Section 3 23-220(1) , C.R.S. , the City Council
may, by resolution, approve and ado such Plat, and if approved, shall fix
the period of time for which the s eet locations shown upon the Plat shall
be reserved for future taking or cquisition for public use; and
WHEREAS, the Council ha , after hearing, determined that it is in the
best interests of the citi ns that said Plat be approved and adopted and
that the location shown up the Plat be reserved, if necessary, for future
taking or acquisition fo public street purposes in order to expedite the
acquisition by the St e of Colorado of undeveloped right-of-way for the
future Fort Collins E ressway.
NOW, THEREFO BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follo
Section That the Bessett Reservation Plat, approved by the
Planning a Zoning Board on November 10, 1988, is hereby approved and
adopted.
S tion 2. That the street locations shown upon the Plat shall be
reser ed for future taking or acquisition for public use until December 31 ,
199 . Nothing herein shall be construed to prohibit or impede the
ne otiation and execution of a lease or other appropriate agreement between
e City and any landowner(s) claiming compensation by reason of this
reservation, which would serve to reserve the subject property without the
necessity of further pursuing the statutory process as provided in Sections
31-23-220, C.R.S. , et seq.

Section 3. That a board of three (3) appraisers be established, which
Board shall consist of the following persons:
Donald Shannon
Michael Ehler
Charles Blazek
and that said Board shall hold a hearing upon the amounts of compensation
to be paid for such reservation, said hearing to be held at 1:30 p.m. on
March 9, 1989, in the City Hall (West) , 300 LaPorte Avenue, Fort Collins,
Colorado.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 15th day of November, A.D. 1988.
