OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE EXPENDITURE OF SUCH STAFF TIME AND RESOURCES AS
ARE REASONABLE AND PRUDENT TO ACCOMPLISH THE
PREPARATION AND DISTRIBUTION OF A FAIR AND BALANCED
FACT SHEET RELATING TO A PROPOSED CHARTER
AMENDMENT PERTAINING TO DIRECT ELECTION OF THE MAYOR
WHEREAS, on September 4, 1990, the Council of the City of Fort Collins
adopted Ordinance No. 100, 1990, submitting a Proposed Charter Amendment
(the "Amendment") to a vote of the registered electors of the City of Fort
Collins; and
WHEREAS, the Colorado Campaign Reform Act (the "Act") provides that
state political subdivisions may make contributions or contributions in
kind to dispense fair and balanced information in campaigns regarding any
issue of official concern before the electorate; and
WHEREAS, "contributions in kind" has been interpreted to include the
expenditure of time by public employees and the use of public facilities
and payment to disseminate information; and
WHEREAS, it is in the best interests of the citizens of the City of
Fort Collins that fair and balanced information be disseminated regarding
the Amendment so as to promote informed decision-making and active
participation on the part of the electorate; and
WHEREAS, the Amendment is a matter of official concern before the
electorate within the meaning of the Act; and
WHEREAS, the Council of the City of Fort Collins wishes to authorize
such contributions in kind as may be necessary to effectuate the
preparation and distribution of a fair and balanced fact sheet concerning
the amendment.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Council hereby authorizes the preparation and distribution
of a fair and balanced fact sheet concerning the Proposed Charter
Amendment, which has been placed before the registered voters of the City
at a Special Municipal Election to be conducted on November 6, 1990, in
conjunction with the General Election, and the expenditures of such staff
time and resources as are reasonably necessary to provide such information.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 2nd day of October, A.D. 1990.
