OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING AN AMENDMENT TO THE MASTER AGREEMENT
BETWEEN THE CITY AND ANHEUSER-BUSCH, INC.
CONCERNING pH CONTROL
WHEREAS, the Master Agreement between the City and Anheuser-Busch,
Inc. , executed on December 31, 1982, provides that the pH of wastewater
discharge from the Anheuser-Busch Brewery to the City wastewater treatment
plant must be within the range of six to nine; and
WHEREAS, the pH range as specified in the City Code for other
commercial and industrial customers is five to nine; and
WHEREAS, the Council has determined that the Master Agreement should
be amended to bring the pH range required of Anheuser-Busch, Inc. , into
compliance with the pH range required of other industrial and commercial
users pursuant to the Code, provided that the loadings from the
Anheuser-Busch Brewery are reduced during the winter months until the new
pH control facilities at Wastewater Treatment Plant No. 2 are completed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Master Agreement between the City and Anheuser-Busch, ,
Inc. , be amended by changing the pH minimum as contained in said Master
Agreement from "6" to "5" upon the condition that Anheuser-Busch, Inc. ,
reduce its wintertime wastewater discharge loadings in accordance with the
specifications of said Modification Agreement until such time as the
permanent pH control/nutrient feed facilities have been fully constructed
and placed in operation at the City's Wastewater Treatment Plant No. 2.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 21st day of August, A.D. 1990.
