HomeMy WebLinkAbout1990-011-02/06/1990-LEGISLATION MUNICIPAL ANNEXATION SB 116 SB 65 RESOLUTION 90-11 OF THE COUNCIL OF THE CITY OF FORT COLLINS REGARDING PROPOSED LEGISLATION PERTAINING TO MUNICIPAL ANNEXATIONS WHEREAS, the Municipal Annexation Act of 1965, as amended, has given rise to significant controversy as it applies to municipal annexations in the Denver metropolitan area; and WHEREAS, various municipalities in Colorado, together with the Colorado Municipal League, have worked together to develop an amendment to the Municipal Annexation Act of 1965 which would resolve many of the controversies and inconsistencies that presently exist with respect to said Act; and WHEREAS, the City of Fort Collins has been active in providing planning and legal assistance to the Colorado Municipal League Committee; and WHEREAS, the result of that effort is embodied in Senate Bill 116 which has been presented to the General Assembly for consideration by Senators Winkler and Allison and Representative Berry; and WHEREAS, the Council of the City of Fort Collins has determined that Senate Bill 116 endorses and encourages intergovernmental cooperation between and among cities and promotes sound and rational municipal planning and growth; and WHEREAS, the Council of the City of Fort Collins has determined that the enactment into law of Senate Bill 116 would be in the best interest of the citizens of the City and the State; and WHEREAS, the Council has further determined that the enactment into law of Senate Bill 65, which has been presented to the General Assembly by Senator Schroeder, would be detrimental to the best interests of the citizens of the City and the State because said Senate Bill 65 does not comprehensively resolve the municipal annexation issues that have arisen in the State and because said Senate Bill 65 affords counties a veto power over flag pole annexations, which annexations have proven to be, in certain instances, beneficial and necessary for the economic development of both the City of Fort Collins and the State generally. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Council supports the adoption into law of Senate Bill 116 and opposes the adoption of Senate Bill 65.
