OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE REQUEST OF THE BOXELDER SANITATION DISTRICT
FOR THE CITY AND THE DISTRICT TO WORK TOWARD CONSOLIDATION
WHEREAS, the Board of Directors ("Board") of the Boxelder Sanitation
District ("District") has determined that it may be in the best interest of
their customers for the District to dissolve; and
WHEREAS, Colorado statute permits special service districts to be
dissolved, subject to court approval , through an agreed upon plan for
dissolution which makes provision for the ongoing operation and maintenance
of the district's system and facilities; and
WHEREAS, the Board of the District at their June 12, 1990 meeting
voted to request that the City of Fort Collins ("City") and the District
begin to work on an agreement for the City to assume responsibility for the
services provided by the District; and
WHEREAS, the City's Wastewater Treatment Master Plan was developed
with the assumption that the City would begin serving District customers in
the near future.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the District's request that the City and the District begin
working on an agreement, pursuant to Colorado statute, for the City to
assume responsibility for the services provided by the District is hereby
approved.
Passed and adopted at a regular meeting of the City Council held this
17th of July, A. D. 1990.
