HomeMy WebLinkAbout1988-097-06/07/1988-POLICY WATER RIGHTS RESOLUTION 88-97 OF THE COUNCIL OF THE CITY OF FORT COLLINS RELATING TO THE WATER AND WATER RIGHTS POLICY OF THE CITY OF FORT COLLINS WHEREAS, the City of Fort Collins, pursuant to its Charter, owns water rights, water delivery systems, associated contractual rights and other interests in water supplies and systems; and WHEREAS, the City holds these water supplies for the use and benefit of its inhabitants and customers; and WHEREAS, through the years, the City has expended great sums of public monies in the acquisition, appropriation, protection and development of these water resources; and WHEREAS, under Colorado law, water rights are the subject of judicial proceedings in the water courts of the state for adjudication, change in use, appropriation and the like; and WHEREAS, the City recognizes that water is necessary for the health and prosperity of all citizens of the City and for the general welfare of the City, and the City further recognizes that the water resources available to the City must be protected and maintained to ensure the City's continued ability to meet the legitimate demands of the City; and WHEREAS, the City desires to confirm its long-standing instructions and policies to its staff for the protection, preservation and maintenance of the City's water resources. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the City Council hereby directs the City Manager to continue to cause the City's water and water rights to be secured and defended. Section 2. That the City Council confirms its long-standing policy of directing the City Manager by lawful and appropriate means to secure for the benefit of the City the full use and enjoyment of the water resources and systems heretofore acquired by contract, purchase or appropriation. Section 3. That the City Council confirms its previous direction and policy to the City Manager to take appropriate steps to assure that the water yields available to the City from purchase of existing water rights and existing water delivery systems are fully available to the City, whether by means of change of use, new appropriation, change of point of diversion, plans for augmentation or other appropriate water court proceedings. Section 4. That, consistent with the long-range policy adopted by City Council on February 21, 1974, the City Manager is directed to fulfill the City's long-standing intent to secure the full measure of water yields anticipated and planned for under said policy by appropriation, change in use, change of point of diversion, plan for augmentation or other appropriate water court proceeding. Section 5. That previous actions by the City, its employees and the City Manager consistent with the intent of this Resolution are hereby approved and confirmed. Section 6. That this Resolution is required to protect the health, safety and welfare of the City and its citizens.
