HomeMy WebLinkAbout1994-038-03/01/1994-BIKE/PEDESTRIAN PATH NATURAL AREA NORTH COLLEGE PURCHASE 5 ACRES UNION PACIFIC RAILROAD COMPANY RESOLUTION 94-38 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE PURCHASE OF APPROXIMATELY 5 ACRES OF LAND AND RIGHT-OF-WAY FOR PUBLIC NATURAL AREA AND BIKE/PEDESTRIAN PATH WHEREAS, the Union Pacific RaiTroad Company is the owner of- approximateTy 5 acres of land adjacent to the Union Pacific Railroad, more particularly described on Exhibit "A," attached hereto and incorporated herein by this reference and referred to herein as "the Property"; and WHEREAS, the City has determined that the reasonable market value of the Property is $23,453; and WHEREAS, the Union Pacific Railroad has agreed to sell the Property to the City for the amount of $23,453; and WHEREAS, the City would use .3 acres of the Property for the North College Bike/Pedestrian Path Project and 4.82 acres for public natural area purposes; and WHEREAS, the Council of the City of Fort Collins has adopted the North College Bike/Pedestrian Path Project; and WHEREAS, one of the objectives of the City's Natural Areas Policy Plan, as adopted by the City Council , is to establish a system of publicly-owned natural areas to protect the integrity of critical conservation sites; preserve outstanding examples of Fort Collins' diverse natural heritage; and provide a broad range of opportunities for educational , interpretive and recreational programs to meet community needs; and WHEREAS, the purchase of the Property is necessary to complete the North College Bike/Pedestrian Path Project and will help fulfill the objectives of the Natural Areas Policy Plan; and WHEREAS, in the November 1992 General Election, the citizens of the City of Fort Collins approved a 1/4 cent sales and use tax for the purpose of acquisition and maintenance of natural areas; and WHEREAS, $19,843 of the purchase price for the Property will come from the Natural Areas Project in the Capital Projects Fund, and $3,610 of the purchase price will come from the North College Bike/Pedestrian Path Project in the Capital Projects Fund, which amounts represent the portions of the Property which will be used for natural areas and bike path purposes, respectively; and WHEREAS, the City Council has heretofore appropriated funds in the Natural Areas Project in the Capital Projects Fund for the purpose of acquisition and maintenance of natural areas, and there are sufficient amounts in this fund to pay for the Natural Area's share of the cost of the Property; and WHEREAS, the City Council has heretofore appropriated funds in the Capital Projects Fund for the purposes of acquiring land and constructing the North College Bike/Pedestrian Path Project and there are sufficient amounts in this fund to pay for the bike path share of the cost of the Property; and WHEREAS, the City Council has determined that the purchase price of the Property is fair and reasonable, and the purchase of the Property is in the best interests of the citizens of the City of Fort Collins; and WHEREAS, the Natural Resources Advisory Board and the Parks and Recreation Board have recommended the acquisition of the Property on the terms and conditions stated above. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Manager and Mayor be, and hereby are, authorized to execute such documents as are necessary for the City to acquire the Property comprising approximately five (5) acres of land, as described on Exhibit "A," for the amount of Twenty-three Thousand Four Hundred and Fifty-three Dollars ($23,453) . Section 2. That approximately 4.82 (4.82) acres of the Property shall be used by the City for public natural areas, and approximately three tenths (0.3) acres of the Property shall be used for bike/pedestrian path right-of-way. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 1st day of March, A.D. 1994.
