HomeMy WebLinkAbout1994-081-05/17/1994-ROOSEVELT NATIONAL FOREST SHEEP CREEK RESERVOIR WATER RIGHTS WATER STORAGE RESOLUTION 94-81 OF THE COUNCIL OF THE CITY OF FORT COLLINS REGARDING THE SHEEP CREEK RESERVOIR WATER RIGHTS WHEREAS, the City of Fort Collins owns a water storage right and a conditional exchange right at the Sheep Creek Reservoir site; and WHEREAS, the City has never been able to store water in the reservoir because the dam for such reservoir was washed out many years before the water rights were transferred to the City; and WHEREAS, the reservoir site is located within the boundaries of the Roosevelt National Forest and would require federal permits for its rehabilitation and operation; and WHEREAS, rehabilitation of the dam does not appear feasible, nor desirable, because of its inaccessibility, its small size, and its potentially environmentally sensitive setting; and WHEREAS, protecting these water rights causes the City to expend funds without any concomitant benefit to the City; and WHEREAS, the Water Board has reviewed the Sheep Creek Reservoir water rights and has recommended that the City should no longer pursue the protection of these water rights. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager be, and hereby is, authorized to no longer pursue the protection of these water rights associated with Sheep Creek Reservoir and to allow the same to become abandoned.
