OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING AN INTERGOVERNMENTAL AGREEMENT WITH THE POUDRE R-1
SCHOOL DISTRICT ESTABLISHING THE BARTON EARLY
CHILDHOOD CENTER LIBRARY
WHEREAS, the Poudre R-1 School District ("the School District") has offered
to establish a small library in the Barton Elementary School that would primarily
contain information concerning childhood education and parenting skills; and
WHEREAS, it is proposed that the library would be established according to
the following terms and conditions:
(1) that the School District would provide space at Barton
Elementary School for the library and would provide computer
equipment, books and library materials, as well as library
operations services; and
(2) the City would provide the library with access to its on-line
library catalog, training and technical support in the use of
the City's library system and a drop box for library
materials, as well as a regular pick up service for library
materials; and
(3) the Barton Early Childhood Center Library would help to
provide additional library services to the Fort Collins
community; and
WHEREAS, Article II, Section 16, of the Charter of the City and Section 29-
1-203, C.R.S. , provides that the City may enter into cooperative or joint
activities with other governmental bodies; and
WHEREAS, Ordinance No. 70, 1993, authorizes the City Manager to execute
agreements between the City and other governmental entities when the proposed
agreement involves the direct, monetary payment of less than $5,000 by the City
and in the judgment of the City Manager does not entail any significant policy
considerations; and
WHEREAS, the Council wishes to formally state its support for this proposed
Intergovernmental Agreement and for the Barton Early Childhood Center Library.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the Council approves and is in support of the proposed Intergovernmental
Agreement with the School District creating the Barton Early Childhood Center
Library, which Agreement is attached hereto as Exhibit "A" and incorporated
herein by this reference.

EXHIBIT A
INTERGOVERNMENTAL AGREEMENT
This agreement is made between Poudre School District R-1
(District) and the City of Fort Collins, Colorado, (City) this
day of January, 1994 as follows:
I. RECITALS
1. This agreement is authorized and required by §29-1-201
C.R.S. et. seq.
2. , Pursuant to §29-1-201, C.R.S. , et. seq. , governments
may cooperate or contract with one another to provide any
function, service or facility lawfully authorized to each of the
cooperating or contracting units of government.
3. The intent and purpose of this agreement is to document
the District ' s and City's rights and duties to jointly administer
a shared library on the premises of Barton Elementary School, 703
East Prospect, Fort Collins, Colorado.
4. . The purpose of the shared library is to provide
specialized materials to serve families with young children,
early childhood educators and interested members of the
community.
5. This agreement, and Exhibit A hereto, shall be liberally
administered and interpreted to effectuate its purpose.
LL,- AGREEMENT
5. Term: This agreement shall begin January 1, 1994 and
shall expire December 31, 1994. The term shall be automatically
extended for successive calendar years unless one party provides
notice to the other by November 1st, of any year that the
Agreement shall not be extended for the following year.
6. Rights and Duties: The rights and duties of the parties
are stated on Exhibit A. The parties agree that, because this
project is new and unique, the Advisory Committee established in
Exhibit A may change the parties' rights and responsibilities in
order to more effectively carry out the purposes of this
agreement. However, any such change must be in writing and
approved by the committee. No such changes shall materially
increase the fiscal obligation of either party without the
consent of the respective governing bodies.
7. Funding contingency: The fiscal obligations of both
parties are contingent upon funds being appropriated and budgeted
for that purpose.
8. Grant Application: A portion of the funding for this
project is through a Federal Grant. Both parties agree to abide
by the conditions of the grant so as to not jeopardize that
funding source.
9. Employment: The employees assigned to carry out this
contract shall, for all purposes, remain employees of the party
who employed them prior to the contract, and that party shall be
responsible for all workers compensation, unemployment
compensation and all other employer obligations.
10. Risk of Loss: The risk of loss of the property
intended to be used to carry out this contract and described in
Exhibit A shall remain with the party providing the property.
This Agreement shall not create any ownership or leasehold
interest in the Barton Library Facility in the City.
11 . Default: In the event of default by either party, the
aggrieved party shall have such rights as are established by
Colorado law. However, neither party may proceed with legal or
equitable action to enforce this agreement without the Advisory
Committee first having the opportunity to resolve the dispute.

All notices permitted or required by this agreement shall be
deemed complete upon delivery of the same to the designated
representatives at the address of the party.

I. PERSONNEL SERVICES.
Poudre R-1 will:
• Set up the library at Barton Elementary School.
• Bar code and enter records for Barton Niche Library
materials into the Fort Collins Public Library's union
catalog.
• Provide data entry and processing for initial and all
on-going Barton Niche Library materials.
• Be responsible for circulation of the Barton Niche
Library materials.
• Staff the Barton Niche Library facility during its
hours of operation.
Remove Barton Niche Library items from the Fort Collins
Public Library drop box prior to courier pick up.
• Repair and maintain the Barton Niche Library facility.
City of Fort Collins will:
• Provide training for and assist the person entering
Barton Niche Library's records into the Dynix System.
• Keep Barton Niche Library_ personnel informed of changes
and updates in the Dynix system.
• Provide technical support and advice in the use of the
Dynix system for the Barton Niche Library staff.
• Maintain the Dynix databases containing Barton Niche
Library records.
• Add the Barton Niche Library to the daily pick-up
schedule.
• Sort and return Barton Niche Library items that are
dropped off at the Fort Collins Public Library to the
Barton Niche Library.
II. MATERIALS.
Poudre R-1 will:
• Select and acquire materials with a focus on parenting
and children.
• Maintain ownership of the materials that are purchased
or donated to the Barton Niche Library.
• Provide the hardware for the automated circulation
system and public access catalog.
• Be responsible for the telecommunications link from
Barton Niche Library to the main terminal server bank
at the Fort Collins Public Library.
• Purchase the licenses for the Dynix system.
City of Fort Collins will:
• Provide two ports on the terminal server board for the
Dynix system.
• Provide a drop box at Barton Niche Library.
• Provide use of existing library space and equipment for
cataloging of the Barton Niche Library collection.
III. PROCESS RESPONSIBILITIES.
• The parties shall establish an advisory committee made
up of School District personnel, City Library and City
personnel, and patrons to provide leadership and guid-
ance in the operation of the Barton Niche Library.
• If materials are challenged, ownership of the materials
determines the reconsideration process to be used.
• Representatives from the School District and the City's
information technologydepartments are responsible for
implementing the telecommunications network and the
hardware set-ups that allow for the operations of the
remote Dynix circulation system at Barton Niche Li-
brary.
• Each party is responsible for maintaining its own
hardware.
• Barton Niche Library will issue Fort Collins Public
Library cards at its site.
• Hours for the Barton Niche Library shall be determined
by the Advisory Committee. The hours for the Fort
Collins Public Library and the Barton Niche Library
will be posted at both sites.
• All of the materials in both libraries ' collections
will be listed on the Fort Collins Public Library

system and both libraries' collections can be viewed on
any public access terminal on the system.
• Items from both libraries' collections may be requested
from either party by a patron and will be delivered to
the site using the City' s courier system.
• Access to and check out of materials is governed by the
policies established for the Barton Niche Library in
collaboration with the Advisory Committee.
• Patrons may return items fitting into a drop box from
either facility to either. facility.
• The City courier system will collect and distribute
items to the correct facility but is not responsible
for sorting items in the Barton Niche Library drop box.
• Barton Niche Library patrons are responsible for lost
and damaged materials. Fines belong to the party
owning the lost or destroyed materials.
VI_ GOVERNANCE.
• Policies and procedures for the Barton Niche Library
shall be consistent with the Intergovernmental Agree-
ment between the City of Fort Collins and Poudre School
District R-1.
• The Advisory Committee with representatives from the
School District, the Early Childhood Center, Fort
Collins Public Library and the City of Fort Collins
will review procedures and make recommendations tQ the-
parties for the operation of the Barton Niche Library.
V. EVALUATION.
A system of evaluation for the Barton Niche Library will
include tha fallowing areas:
Qualitative surveys of patrons and employees.
• Number of people using the system.
• Circulation statistics.
• New library card issuance at the Barton Niche Library
site.
• Tracking both monetary and in-kind expenditures.

VI. DURATION OF THE PROJECT.
The Barton Niche Library link with the Fort Collins Public
Library will continue until terminated by either party but shall
be reviewed annually.
In case of dissolution:
• All materials, licenses, and equipment which are owned
by the School District will remain the property of the
School District.
• The City will reimburse the School District for the two
ports of the terminal server board which it has pur-
chased.
• The School District will be responsible for any tele-
communication charges that have been incurred by the
Barton Niche Library.
• The drop box will remain the property of the City.
• Purging the Dynix database of Barton Niche Library's
records will be the responsibility of the City.
VII. PROMOTION.
• The Barton Niche Library Advisory Committee will col-
laborate on joint promotion of the Barton Niche Li-
brary.
