HomeMy WebLinkAbout1992-064-04/07/1992-CITY COUNCIL CONFIDENTIAL DISTRIBUTION OF INFORMATION POLICY PUBLIC TERMINAL RESOLUTION 92-64 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING THE COUNCIL POLICY REGARDING THE DISTRIBUTION OF INFORMATION TO COUNCIL WHEREAS, the Fort Collins City Council desires to maintain a general policy of providing public access to information received by the Council ; and WHEREAS, on October 15, 1991 , the Council adopted Resolution 91-136, establishing a policy which set forth specific categories for information which is disseminated to the Council by City staff and identified the kinds of documents which should be placed in each category; and WHEREAS, on January 21 , 1992, the Council amended Resolution 91-136 to eliminate the "non-public" category of information; and WHEREAS, the Council wishes to again amend Resolution 91-136 to extend the application of the policy to electronic communications to and among councilmembers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that Resolution 92-17 is hereby amended so that the following categories will be hereafter used for information provided to, and exchanged among, the City Council : 1 . Memos and Correspondence: a. No classification - generally, all memos to Council and correspondence to and from citizens that are not designated as "confidential " will be promptly made available to the public by placing copies of such memos and correspondence in a public inspection basket in the City Manager' s office. b. Confidential - information falling into this category will be kept confidential . Such information would include: memos from the City Attorney's Office and outside counsel providing legal advice; the contents of employees' personnel files (except applications and performance ratings) ; trade secrets; confidential commercial and financial data; and any other information required or permitted by law to be kept confidential . 2 . Electronic Communications: a. Definition - for the purpose of this policy, "electronic communications" shall mean the exchange of information by the use of telecommunication facilities, when the information is received in visual , rather than auditory, form. b. Public terminal - a computer terminal available to the public shall be provided in City Hall West for the purpose of permitting public access to electronic communications covered by this policy. City staff is hereby directed to add a "Public" user sign-on capability to the existing "Council " and "Questions" distribution lists. C. Communications among councilmembers - all electronic communications among any number of councilmembers shall be made available to the public by inclusion of the "Public" user in the distribution lists for such messages. d. Communications from City staff to Council - all communications from City staff to the "Council " or "Questions" distribution lists shall also be made available to the public by inclusion of the "Public" user, except for those communications that fall within the "confidential " category as described in Section 1(b) of this Resolution.
