OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE EXECUTION OF AN INTERGOVERNMENTAL
AGREEMENT BETWEEN THE CITY AND THE STATE OF
COLORADO FOR THE PURPOSE OF IMPLEMENTATION
OF THE CLEAN AIR COLORADO PROGRAM IN
FORT COLLINS
WHEREAS, the City is the implementing agency for certain air pollution
control measures included in the State Implementation Plan under the Federal
Clean Air Act and the Colorado Air Quality Control Act to reduce carbon monoxide
and improve air quality in the Fort Collins region; and
WHEREAS, the State Air Pollution Control Division, Clean Air Colorado
("Clean Air Colorado") is responsible for overseeing the Fort Collins Clean Air
Colorado Campaign; and
WHEREAS, Clean Air Colorado has broadened its focus to include visibility,
global warming, acid rain, ozone depletion and health and environmental risks
associated with air pollution; and
WHEREAS, Clean Air Colorado is focusing its efforts on longer term,
measurable air pollution reduction programs; and
WHEREAS, during the year 1992, it is anticipated that the City will adopt
an Air Quality Strategic Plan, which will respond to the community desires for
clean air, as well as federal and State air quality laws and regulations; and
WHEREAS, certain projects may be performed by the City in pursuance both
of the Fort Collins Clean Air Colorado Campaign and the anticipated Air Quality
Strategic Plan, including among them an air quality report for the community and
other educational presentations; and
WHEREAS, certain pilot projects have been developed which will be
beneficial in testing implementation strategies and producing measurable air
quality benefits; and
WHEREAS, the State of Colorado, for the use and benefit of the Department
of Health, has agreed to enter into an intergovernmental agreement for the
purpose of providing funding in the sum of Thirty Thousand Dollars (b30,000) to
the City in order to enable the City to implement the Clean Air Colorado program
in the Fort Collins area;
WHEREAS, the Council has determined that it is in the best interests of the
citizens of the City that said intergovernmental agreement be executed between
the City and the State for the purpose of providing said funding for the Clean
Air Colorado Program; and
WHEREAS, pursuant to Section 29-1-203, C.R.S. , and Article II, Section 16
of the Fort Collins City Charter, the City Council may, be resolution, enter into
a contract with the State of Colorado for the purpose of performing a cooperative
or joint activity.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the Mayor be, and hereby is, authorized to execute an intergovernmental
agreement between the City and the State of Colorado (for the use and benefit of
the Department of Health) for the purpose of the implementation of the Clean Air
Colorado Campaign in the Fort Collins area and for the purpose of providing
funding in the sum of Thirty Thousand Dollars (E30,000) in aid of that
implementation.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 4th day of February, A.D.(' 1992.
