OF THE COUNCIL OF THE CITY OF FORT COLLINS
MAKING FINDINGS AND RENDERING
A DECISION WITH REGARD TO THE
PULSE P.U.D. , REVISED PRELIMINARY PLAN
WHEREAS, the Planning and Zoning Board of the City of Fort Collins, on
April 20, 1987, after receiving testimony and other evidence at its hearing
regarding the Pulse P.U.D. Revised Preliminary Plan 1 .57 acres (the
"Development") , rendered its decision of denial of the proposed
Development; and
WHEREAS, subsequent to the decision of the Planning and Zoning Board,
D & S Properties, Inc. , the developer of the Development, appealed to the
Council of the City of Fort Collins, requesting reconsideration of the
decision of the Planning and Zoning Board; and
WHEREAS, on the 2nd day of June, 1987, the Council , in accordance with
Chapter 3A of the Code of the City of Fort Collins, held its hearing with
regard to said appeal , and fully examined the record on appeal ; and
WHEREAS, at said hearing before the City Council , presentations were
heard by the City staff, the appellant, and opponents of the appeal , all
being parties in interest to the appeal ; and after due deliberation and
consideration of the record on appeal and the presentations made before the
Council , the Council hereby finds and determines that the evidence in the
record on appeal supports the finding of the Planning and Zoning Board,
that the Development does not meet certain criteria as established for the
approval of planned unit developments in the Code of the City of Fort
Collins; and
WHEREAS, the Council further finds that the decision of the Planning
and Zoning Board should, accordingly, be upheld.
NOW, THEREFORE, be it resolved by the Council of the City of Fort
Collins that the April 20, 1987 Planning and Zoning Board decision of
denial of the Pulse P.U.D. , Revised Preliminary Plan, be, and the same
hereby is, upheld.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 7th day of July, A.D. 1987.
