OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AGREEMENT WITH COLORADO STATE UNIVERSITY FOR
CONSTRUCTION OF AN ALL-WEATHER TRACK FACILITY
WHEREAS, Colorado State University (C.S.U.) in Fort Collins owns a
track facility located between the streets of South College Avenue, Pitkin
Street, Mason Street and University Avenue in the City of Fort Collins; and
WHEREAS, C.S.U. has proposed the reconstruction of the C.S.U. track
facility to include an upgraded all -weather surface, together with public
facilities and improvements thereto; and
WHEREAS, the City of Fort Collins has determined that there are
certain public benefits to come to the City of Fort Collins upon the
construction of the track facility and the City desires to contract with
C.S.U. for the construction of the track facility.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1 . The City Manager is authorized on behalf of the City to
enter into an Agreement with C.S.U. for construction by C.S.U. of an
all -weather track to include the following:
a. The track will be constructed at the location in the
City of Fort Collins between the streets of South College Avenue,
Pitkin Street, Mason Street and University Avenue, together with
public improvements, all utilities thereto, fencing, landscaping,
curbs, gutters and sidewalks, as described in the project
proposals submitted to the City.
b. The City shall pay $ 100 , 000 from the Economic
Development account and $20,000 from the maintenance and
mitigation account to C.S.U. for construction of the project when
it is determined by the parties that funds are available to
complete the project described.
c. The improvements shall be completed not later than
May 1, 1988.
d. As a part of the performance of C.S.U. , it will allow
public access to the track at such times as the facility is not
scheduled for C.S.U. activities or other scheduled use, upon
terms and conditions established by C.S.U. for the operation and
management of the facility.
Section 2. Upon the execution of an Agreement with C.S.U. , the City
Manager is further authorized to execute such other agreements, documents
or instruments as are necessary to accomplish the purposes of this
Resolution.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 2nd day of June, A.D. 1987.
