HomeMy WebLinkAbout1988-169 A-10/18/1988-DISTRIBUTION FACILITIES IGA WATER DISTRICT WEST FORT COLLINS RESOLUTION 88-169A OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE WEST FORT COLLINS WATER DISTRICT TO EXCHANGE CERTAIN WATER DISTRIBUTION SYSTEM FACILITIES AND CUSTOMERS WHEREAS, both the City of Fort Collins ("City") and the West Fort Collins Water District ("District") own and operate water utilities in Larimer County for the purpose of distribution of potable water; and WHEREAS, the service areas for the City and the District are, in some areas, overlapping; and WHEREAS, the overlapping of service areas is a source of confusion among customers, duplication of effort by the City and the District, and inefficient use of the distribution system facilities of the City and the District; and WHEREAS, the parties have determined that it is their mutual best interest to exchange facilities and customers for the purpose of separating service areas, making better use of their respective facilities and otherwise benefitting the City and the District; and WHEREAS, the District and the City have the authority, pursuant to Article XIV, Section 18, of the Colorado Constitution, and Section 29-1-201 et seq. , C.R.S. , to enter into intergovernmental agreements for the purpose of providing any service or function which they can perform individually. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be, and he hereby is, authorized to enter into an intergovernmental agreement with the West Fort Collins Water District for the purpose of exchanging certain distribution facilities and customers.
