OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE RULES AND REGULATIONS FOR
THE OPERATION OF MUNICIPAL CEMETERIES
WHEREAS, on October 16, 1984, the City Council adopted the Rules and
Regulations for the Operation of Municipal Cemeteries, which Rules and
Regulations were amended in part by Resolution 88-32, adopted on March 1,
1988; and
WHEREAS, the City Council now desires to amend certain provisions in
said Rules and Regulations in order to update and clarify such provisions.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the following paragraphs of the Rules and Regulations for the
Operation of Municipal Cemeteries be, and the same hereby are, amended as
follows:
Section 1. Paragraph 11 .2 is amended to read as follows:
11.2 DISPOSITION-REMOVAL PERMIT REQUIRED
A Disposition-Removal Permit issued by the Colorado Department of
Health, OR, IF THE DEATH OCCURRED OUTSIDE COLORADO, A SIMILAR
PERMIT ISSUED BY THE STATE IN WHICH THE DEATH OCCURRED, is
required prior to any interment. Such permit must be provided by
the Funeral Director to the Cemetery Office.
Section 2. The first paragraph of Paragraph 11.5 is amended to read
as follows:
All interments must be scheduled through the Cemetery Office. No
interment or funeral services will be allowed on Saturday
afternoons or Sundays or on any of the following holidays:
New Year's Day - MARTIN LUTHER KING DAY - Washington's
Birthday - Memorial Day - Independence Day - Colorado
Bay - Labor Day - Veteran's Day - Thanksgiving Day
Christmas Bay
or upon the days that these holidays are legally observed. No
interments will be allowed on Saturday mornings except on the
Saturday mornings which follow a Friday holiday or precede a
Monday holiday.
Section 3. Paragraph 11.8 is amended to read as follows:
11.8 CASKET NOT TO BE DISTURBED
Once a casket or other burial receptacle containing a body is in
the confines of a Cemetery, no funeral director or his embalmer,
assistant, employee, agent, Cemetery official or employee, or any
other person shall be permitted to open a casket or to touch the
body without the WRITTEN consent of the legal representatives of
the deceased or a court order.
Section 4. Paragraph 13.1.4 is amended to read as follows:
13.1.4 Artificial or fresh cut flowers may be placed in a
metal vase at any time; however, they will be discarded when
dead, faded, broken or of a similar nature. Such a vase must be
set in concrete with a minimum three (3) inch border and within
six (6) inches of the monument or be an actual part of the
monument. The-Cemetery-crew-shall-4nstall-all-vases: FOUNDATION
WORK (INCLUDING THE INSTALLATION OF VASES) MUST EITHER BE
PERFORMED BY THE CEMETERY CREW OR AN APPROVED, BONDED RETAIL
DEALER (SEE PARAGRAPH 14.1 BELOW) WHO HAS PAID AN ADMINISTRATIVE
MEMORIAL SETTING FEE, AS ESTABLISHED BY THE CITY.
Section 5. Paragraph 13.2.5 is amended to read as follows:
13.2.5 Artificial or fresh cut flowers may be placed in a
metal vase at any time; however, they will be discarded when
dead, faded, broken or of a similar nature. Such a vase must be
set in concrete with a minimum three (3) inch border and within
six (6) inches of the monument or be an actual part of the
monument. The-Cemetery-erew-shall-Install-all-vases: FOUNDATION
WORK (INCLUDING THE INSTALLATION OF VASES) MUST EITHER BE
PERFORMED BY THE CEMETERY CREW OR AN APPROVED, BONDED RETAIL
DEALER (SEE PARAGRAPH 14.1 BELOW) WHO HAS PAID AN ADMINISTRATIVE
MEMORIAL SETTING FEE, AS ESTABLISHED BY THE CITY.
Section 6. Paragraph 14.2.3 is amended to read as follows:
14.2.3 If more than one memorial is to be placed on a
burial space, the second memorial must be made of granite and set
flush with the ground directly in front of the main memorial , and
must not exceed 2' x 1' x 4" in size. A GOVERNMENT HEADSTONE OR
MARKER FURNISHED BY THE VETERANS' ADMINISTRATION MAY NOT BE SET
ON A PREVIOUSLY-MARKED BURIAL SPACE (38 U.S.C. §906) .
Section 7. Paragraph 14.2.5 is amended to read as follows:
14.2.5 The area of the face of any memorial shall not
exceed thirty percent (30%) of the area of the lot. The length
of the base of the memorial shall not exceed seventy-five percent
(75%) of the width of the lot. The width of the base of the
memorial shall not exceed twenty percent (20%) of the length of
the lot. Any die or monolith shall have a thickness of at least
eight (8) inches. BEGINNING APRIL 1, 1989, ANY DIE OR MONOLITH
SHALL HAVE A THICKNESS OF AT LEAST EIGHT (8) INCHES IF IT IS MORE
THAN THREE FEET SIX INCHES (3'6') IN LENGTH.
Section 8. Paragraph 14.3.2 is amended to read as follows:
14.3.2 If more than one memorial is to be placed on a
burial space, the second memorial must be made of granite and set
flush with the ground directly in front of the main memorial , and
must not exceed 2' x I' x 4" in size. A GOVERNMENT HEADSTONE OR
MARKER FURNISHED BY THE VETERANS' ADMINISTRATION MAY NOT BE SET
ON A PREVIOUSLY-MARKED BURIAL SPACE (38 U.S.C. §906) .
Section 9. Paragraph 14.3.6 is amended to read as follows:
14.3.6 In Section 2 and 3, the area of the face of any
memorial shall not exceed twenty percent (20%.) of the area of the
lot. The length of the base of the memorial shall not exceed
seventy-five percent (75%) of the width of the lot. The width of
the base of the memorial shall not exceed twenty percent (201%) of
the length of the lot. Any die or monolith shall have a
thickness of at least eight (8) inches. BEGINNING APRIL 1, 1989,
ANY DIE OR MONOLITH SHALL HAVE A THICKNESS OF AT LEAST EIGHT (8)
INCHES IF IT IS MORE THAN THREE FEET SIX INCHES (3'6") IN LENGTH.
Passed and adopted at a regular meeting of the Council of the City of
