OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO EXECUTE AN ADDENDUM
TO THE AGREEMENT WITH THE UNION PACIFIC RAILROAD COMPANY
REGARDING POWER LINE CROSSING AND ENCROACHMENTS
WHEREAS, in 1974 the City of Fort Collins and the Union Pacific
Railroad Company ("Railroad") entered into an agreement whereby the City
was given permission to erect overhead power lines on and across Railroad
right-of-way; and
WHEREAS, this Agreement expired in June of 1984; and
WHEREAS, the City is in the process of converting these overhead lines
to underground lines and needs to renew the Agreement until all lines are
converted and there is no longer a need to use the Railroad right-of-way;
and
WHEREAS, the Railroad has tendered to the City a Renewal Rider to the
Agreement covering power line crossing and encroachments on, along, and
across right-of-way and over the tracks at Fort Collins; such Agreement
being identified in the records of the Railroad as its C.D. No. 38879-2-A;
and
WHEREAS, it is in the best interests of the City that the Renewal
Rider to the Agreement be executed and the terms of the Agreement extended
until such time as renewal is no longer needed by the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor be, and he hereby is, authorized to execute Renewal
Rider #CD 38879-2-A to Agreement with the Union Pacific Railroad Company
covering power line crossing and encroachments on, along and across
right-of-way and over the tracks at Fort Collins.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 7th day of October, A.D. 1986.
