HomeMy WebLinkAbout1986-156-10/07/1986-LEASE PICNIC ROCK WATER TRANSMISSION LINES RESOLUTION 86-156 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF CITY OWNED PROPERTY AT PICNIC ROCK TO THE COLORADO DIVISION OF PARKS AND RECREATION WHEREAS, the City of Fort Collins owns four acres of land along the Poudre River near Picnic Rock, which property was acquired to secure a permanent right-of-way for two water transmission lines which are still used by the City; and WHEREAS, the Colorado Division of Parks and Recreation in cooperation with Larimer County has developed a plan to construct a restroom facility and adjoining parking lot at the Picnic Rock site; and WHEREAS, the purpose of this development is to control potential public health and water quality problems arising from the presently uncontrolled use of the site; and WHEREAS, the Colorado Division of Parks and Recreation has proposed to lease the City's property for the construction of the parking lot; and WHEREAS, the City has no designated use for the property with the exception of the permanent right-of-way for the water lines; and WHEREAS, City staff recommends leasing the property for a period of three years during which time negotiations will be undertaken for the sale or trade of the property to the State; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager be, and he hereby is, authorized to enter into a lease agreement with the Colorado Division of Parks and Recreation for City-owned property along the Poudre River at Picnic Rock, which lease agreement shall be subject to and subordinate to the paramount City interest in its two water transmission lines presently located at the site.
