Home My WebLink About1986-125-07/15/1986-AIRPORT AUTHORITY FORT COLLINS LOVELAND INDEMNIFICATION RESOLUTION 86- 125 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO ENTER AN INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF LOVELAND AND THE FORT COLLINS-LOVELAND AIRPORT AUTHORITY WHEREAS, the City of Fort Collins, Colorado, by Ordinance No. 74, 1983 and the City of Loveland, by Ordinance No. 2092, 1983, created the Fort Collins-Loveland Airport Authority; and WHEREAS, the City Councils of the Cities of Fort Collins and Loveland deem it necessary and appropriate to enter into an intergovernmental agreement with the Authority to provide indemnification of the public employees of the Authority for claims made against such public employees acting within the scope of their employment under certain circumstances, because of the unavailability of adequate insurance coverage for the Authority and its public employees. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be, and he hereby is, authorized and directed to enter into an intergovernmental agreement among the City of Fort Collins, the City of Loveland and the Fort Collins-Loveland Airport Authority by which the Cities of Fort Collins and Loveland shall agree to indemnify and hold harmless the public employees of the Authority from civil liability arising out of these errors and omissions of such public employee for which no immunity exists, which agreement shall be in form and substance approved by the City Attorney, and which agreement shall provide for a monetary limit of liability equal to those provided under the Colorado Governmental Immunity Act, and which shall not provide for indemnification from punitive damages or other liability stemming from acts or omissions of employees which constitute gross negligence, gross misconduct or willful and wanton conduct.
