OF THE COUNCIL OF THE CITY OF FORT COLLINS
REGARDING THE PROVISION OF WATER SERVICE
FOR CERTAIN TERRITORIES SOUGHT TO BE EXCLUDED FROM THE
FORT COLLINS-LOVELAND WATER DISTRICT
WHEREAS, the Fort Collins-Loveland Water District (The District) has,
in Civil Action No. 13593, petitioned the District Court of Larimer County
for exclusion of certain territory from the District ; and
WHEREAS, pursuant to Colorado Revised Statute 32-1-502(2)(a) , the
governing body of the affected municipality must agree, by resolution, to
provide the service provided by the District to the area described in the
petition, on and after the effective date of the exclusion order; and
WHEREAS, the Council of the City of Fort Collins has determined that
it is in the best interest of the citizens of the City to agree to provide
the service as aforesaid; and
WHEREAS, it is further the declaration of the Council of the City of
Fort Collins that the petition for the exclusion of territory from the Fort
Collins-Loveland Water District, and the provision of water service
therefor by the City of Fort Collins is in the best interest of the
citizens of the City and that the Council of the City of Fort Collins does
hereby recommend to the District Court of the County of Larimer that the
aforesaid petition, as amended, be granted and that the exclusion order be
issued.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City of Fort Collins does hereby agree to provide the
water service provided by the Fort Collins-Loveland Water District (or as
might have been provided by the District) to the area as described in the
petition, as amended, presently on file with the District Court in Civil
Action No. 13593, on and after the effective date of the exclusion order to
be issued by the Court ; and
BE IT FURTHER RESOLVED that the City Manager be and he hereby is
authorized to submit to the District Court a plan for disposition of assets
in accordance with law, or as may be necessary, to enter into a contract
with the Fort Collins-Loveland Water District for the purpose of
accomplishing the exclusion of certain territories within the City of Fort
Collins from the boundaries of the Fort Collins-Loveland Water District,
all as set forth in the recitals hereto.
Passed and adopted at a regular meeting of the City Council held this
1st day of July, A.D. 1986.
