HomeMy WebLinkAbout1987-005-01/06/1987-PUBLIC RIGHT OF WAY R P PLAZA LTD REVOCABLE PERMIT ROBINSON PIERSAL PLAZA RESOLUTION 87- 5 -- OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE ISSUANCE OF A REVOCABLE PERMIT TO R.P. PLAZA, LTD. , FOR CONSTRUCTION IN THE PUBLIC RIGHT-OF-WAY OF IMPROVEMENTS RELATED TO THE ROBINSON-PIERSAL PLAZA WHEREAS, on November 18, 1985, the Planning and Zoning Board granted final approval to the Robinson Piersal Plaza P.U.D. , which approval was conditioned upon the granting by the City of a revocable permit to R.P. Plaza, Ltd. , the developer of the Robinson Piersal Plaza P.U.D. (the "Developer") for the encroachment of the service area of the P.U.D. into the Magnolia Street right-of-way; and WHEREAS, the Developer has made application for a revocable permit for the following: surface encroachment for the service area and related improvements into Magnolia Street subsurface encroachment for foundations and mechanical and electrical systems into College Avenue, Magnolia, Remington and Mulberry Streets surface encroachment for landscaped area wells into College Avenue, Remington and Mulberry Streets; and WHEREAS, all of the affected utility companies and the State Highway Department have reviewed the request and have no objections to the encroachments; and WHEREAS, Article XIII, Section 10 of the Charter of the City of Fort Collins authorizes the Council to grant a revocable permit at any time for the temporary use or occupation of any street, alley or public place. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be, and he hereby is, authorized to execute a revocable permit with R.P. Plaza, Ltd. which permit would allow the following encroachments in conjunction with the construction of the Robinson Piersal Plaza, P.U.D. : 0 surface encroachment for the service area and related improvements into Magnolia Street subsurface encroachment for foundations and mechanical and electrical systems into College Avenue, Magnolia, Remington and Mulberry Streets surface encroachment for landscaped area wells into College Avenue, Remington and Mulberry Streets. Passed and adopted at a regular meeting of the Council of the City of Fort Collins-held this 6th day of January, A.D. 1987. Mayor ATTEST: City Clerk
