HomeMy WebLinkAbout1987-157-10/20/1987-ACQUISITION EMINENT DOMAIN PROCEEDINGS REPLACEMENT BRIDGE SUMMIT VIEW DRIVE RESOLUTION 87- 157 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN PROCEEDINGS OF CERTAIN LANDS FOR BRIDGE IMPROVEMENTS WHEREAS, the City of Fort Collins desires to acquire certain properties hereinafter described for the purpose of constructing the Summit View Drive Replacement Bridge over the Larimer-Weld Canal ; and WHEREAS, the City has previously attempted to negotiate the acquisition of said properties from the owners thereof, which negotiations have been unsuccessful ; and WHEREAS, the acquisition of the same is desirable and necessary for public use and said acquisition may, by law, be accomplished through proceedings in eminent domain. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. The City hereby finds and determines that it is necessary that the City of Fort Collins acquire certain properties described as follows for the construction of a replacement bridge with related improvements and facilities: DESCRIPTION FOR SUMMITVIEW PROPERTIES A tract of land located in the Southwest Quarter of Section 5, Township 7 North, Range 68 West of the Sixth Principal Meridian, Larimer County, Colorado being more particularly described as follows: Considering the East line of the Southwest Quarter of said Section 5 as bearing North 0°00'00" West and with all bearings contained herein relative thereto: Commencing at the South Quarter Corner of said Section 5; thence along said East line of said Southwest Quarter, North 0000'00" West, 2173.59 feet to a point on the centerline of Larimer and Weld Canal and the POINT OF BEGINNING; thence, South 0°00'00" East, 207.59 feet; thence, North 45'00'00" West, 70.71 feet; thence, North 000010011 West, 72.00 feet; thence, North 80°00'00" West, 23.00 feet; thence, North 0000'00" West, 50.36 feet to a point on the centerline of Larimer and Weld Canal ; thence along said canal centerline, North 72°00'00" East, 48.71 feet; thence, North 58024'43" East, 30.90 feet to the POINT OF BEGINNING. The above described tract of land contains 0.223 acres more or less. DESCRIPTION FOR DONALD A. MCMAHEN PROPERTY A tract of land located in the Southeast Quarter of Section 5, Township 7 North, Range 68 West of the Sixth Principal Meridian, Larimer County, Colorado being more particularly described as follows: Considering the West line of the Southeast Quarter of said Sec- tion 5 as bearing North 0°00'00" West and with all bearings con- tained herein relative thereto: Commencing at the South Quarter corner of said Section 5; thence along said West line of said Southeast Quarter, North 0°00'00" West, 1595.00 feet to the POINT OF BEGINNING, thence continuing North 0000'00" West, 513.60 feet more or less to the South right- of-way of Larimer and Weld Canal ; thence along said South right- of-way, North 72°27'00" East, 52.44 feet; thence leaving said South right-of-way, South 0°00'00" East, 108.41 feet; thence, South 45000'00" West, 28.28 feet; thence, South 00000'00" East, 414.66 feet; thence, North 65031'00" West, 32.96 feet to the Point of Beginning. The above described tract of land contains 0.415 acres more or less. Section 2. The City Council hereby authorizes the City Attorney and other proper officials of the City to acquire the same for the City by eminent domain proceedings Passed and adopted at a regular meeting of the City Council held this 20th day of October, A.D. 1987.
