OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN
INTERGOVERNMENTAL AGREEMENT WITH THE
BOARD OF COMMISSIONERS OF LARIMER COUNTY
AND THE BELLVUE WATER ASSOCIATION
TO REPLACE THE DETERIORATING
BELLVUE WATER DISTRIBUTION SYSTEM
WHEREAS, the citizens of Bellvue are presently served by the Bellvue
Water Association, a wholesale customer of the City; and
WHEREAS, the City desires to make additions and improvements to the
water distribution system in and near the Town of Bellvue; and
WHEREAS, the Association will receive primary benefit from the planned
improvements by allowing each member to become an individual customer of
the City, the dissolving of the Association and the abandonment of their
deteriorating private water distribution system; and
WHEREAS, the Association desires to dissolve, and the Board of
Commissioners of Larimer County, on behalf of the Association, has made
application and received a Community Development Block Grant to reimburse
the City for a portion of the costs associated with the construction of the
planned improvements; and
WHEREAS, the Association and the County will reimburse the City for
the remaining portion of the costs associated with the construction; and
WHEREAS, the Association, the City and the County have the authority,
pursuant to Article XIV, Section 18, of the Colorado Constitution, and
Section 29-1-201 et seq. , C.R.S. , to enter into intergovernmental
agreements for the purpose of providing any service or performing any
function which they can perform individually; and
WHEREAS, the parties desire to cooperate in developing and carrying
out this water distribution system improvement project utilizing CDBG
funding and funding from the Association and the County.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor be, and he hereby is, authorized to enter into an
intergovernmental agreement with the Board of Commissioners of Larimer
County and the Bellvue Water Association for the purpose of replacing the
deteriorating Bellvue water distribution system, for a cost not to exceed
$55,000, utilizing Larimer County CDBG funds in the sum of $42,000, other
funds of the County in the sum of $4,675, and funds of the Association in
the amount of $8,325.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 20th day of October, A.D. 1987.
