HomeMy WebLinkAbout1988-050-04/12/1988-AMENDING FINAL PLAN APPEAL FINDINGS OF FACT PLANNING AND ZONING BOARD ROBINSON PIERSAL PLAZA PUD RESOLUTION 88-50 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING FINDINGS OF FACT REGARDING THE APPEAL OF THE PLANNING AND ZONING BOARD APPROVAL OF THE AMENDED FINAL PLAN OF THE ROBINSON-PIERSAL PLAZA P.U.D. , AND UPHOLDING THE DECISION OF THE BOARD WHEREAS, on February 22, 1988, the Planning and Zoning Board approved the Amended Final Plan of the Robinson-Piersal Plaza P.U.D. (the "Development") ; and WHEREAS, on March 7, 1988, the Collins House Partnership filed a notice of appeal , appealing the aforesaid decision of the Planning and Zoning Board; and WHEREAS, on April 5, 1988, the City Council considered said appeal as filed by the Collins House Partnership; and WHEREAS, upon hearing and after full consideration of the evidence as presented to the Planning and Zoning Board, and after hearing argument thereon, the Council made the following findings of fact: 1 . The Development complies with the applicable criteria of the Land Development Guidance System. 2. The Development is compatible with the surrounding neighborhood. 3. The Development is properly landscaped and buffered to adequately mitigate its impact upon the surrounding neighborhood. 4. The traffic impacts of the Development have been adequately considered and mitigated. 5. The Planning and Zoning Board properly interpreted and applied the relevant provisions of the City Code and Charter. 6. The Planning and Zoning Board conducted a fair hearing. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the decision of the Planning and Zoning Board of February 22, 1988, approving the amended final plan of the Robinson-Piersal Plaza P.U.D. be, and hereby is, upheld.
