HomeMy WebLinkAbout1990-177-12/18/1990-AIRPORT RUNWAY IMPROVEMENTS EMINENT DOMAIN PROCEEDINGS LANDS RESOLUTION 90 - 177 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN PROCEEDINGS OF CERTAIN LANDS FOR AIRPORT RUNWAY IMPROVEMENTS WHEREAS, the Fort Collins-Loveland Municipal Airport ("Airport") is jointly owned and operated by the City of Fort Collins and the City of Loveland; and WHEREAS, the Cities of Fort Collins and Loveland ("Cities") desire to acquire that certain property ("Property") which is described on Exhibit A, attached hereto and incorporated herein by this reference, for the purpose of facilitating existing Airport operations and assuring the preservation of extended runway approaches in connection with the following Federal Aviation Administration Project No. 3-08-0023-02: Extend runway 15 (100' x 2,000' ) and parallel taxiway (50' x 2,500' ) (site preparation only) ; relocate localizer; replace and extend runway lighting system (HIRL) . WHEREAS, the City of Fort Collins, as a representative of both Cities, has attempted to negotiate the acquisition of said property from the owners thereof, which negotiations have been unsuccessful ; and WHEREAS, the acquisition of the property is desirable and necessary for public use and said acquisition may, by law, be accomplished through proceedings in eminent domain. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1 . That the City hereby finds and determines that it is necessary and that it will serve the best interests of the public for the City of Fort Collins to acquire the Property in order to facilitate the operation of extended airport runway approaches for the Fort Collins-Loveland Municipal Airport. Section 2. That, upon passage of a resolution or ordinance authorizing acquisition by eminent domain by the City of Loveland, said acquisition shall be pursued and the Property shall be acquired through eminent domain proceedings by the Cities of Loveland and Fort Collins, to be held as tenants in common. Section 3. That the City Attorney or designee thereof and other proper officials of the City are hereby authorized to acquire the Property by proceedings in eminent domain. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 18th day of December, 1990. Mayor ATTEST: City Clerk 2 EXHIBIT A TO RESOLUTION 90- 177 LEGAL DESCRIPTION: That portion of the N 1/2 of Section 28, Township 6 North, Range 68 West of the 6th P.M. , Larimer County, Colorado more particularly described as follows: Considering the North line of the NW 1/4 of said Section 28 as bearing East and West and with all bearings contained herein relative thereto: Beginning at the Northwest Corner of said Section 28; thence along the North line of said Section 28 East 820. 14 feet to the true point of beginning; thence South 28*47' East 164.69 feet; thence South 41*55' East 152.85 feet; thence South 0*09' East 157.83 feet; thence East 231 .41 feet to a point on the Centerline of the Louden Ditch as it now exists; thence along said Centerline through the following courses and distances; South 19'30' East 131 .00 feet; thence South 14*30' East 150 feet to the beginning of a tangent curve concave to the Northeast having a central angle of 39*44' and a radius of 217.0 feet; thence Southeasterly along the arc of said curve 150.48 feet to the end of the said curve; thence tangent from said curve South 54*14' East 115.00 feet to the beginning of a tangent curve concave to the North having a central angle of 43*06' and a radius of 91 .0 feet; thence Southeasterly along the arc of said curve 68.45 feet to the end of said curve; thence Northerly 889.68 feet to a point on the North line of said Section 28, said point being 1525.26 feet East of the Northwest corner of said Section 28; thence West along North line of said Section 28, 705.12 feet to a point of beginning.
