OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL
AGREEMENT WITH THE FORT COLLINS-LOVELAND WATER
DISTRICT FOR THE SALE OF TREATED WATER AND
TERMINATING CERTAIN EXISTING AGREEMENTS
WHEREAS, on November 16, 1989, the City of Fort Collins ("the City") and
the Fort Collins-Loveland Water District ("the District") entered into an
agreement for the mutual treatment, transmission and delivery of drinking water;
and
WHEREAS, on May 31, 1990, the City and the District entered into an
agreement for the sale of drinking water by the City to the District; and
WHEREAS, the District has determined to delay any major expansion of its
treatment facility, and accordingly, will not need the benefit of the agreement
between the City and the District for the mutual treatment, transmission and
delivery of drinking water; and
WHEREAS, because of the District's delay in expansion of its treatment
facility, the District desires a longer term agreement with the City for the sale
of drinking water to the District; and
WHEREAS, for the foregoing reasons, the City and the District wish to
terminate the aforesaid agreements and enter into a new agreement for the sale
of drinking water by the City to the District.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the Mayor be, and she hereby is, authorized to enter into an
intergovernmental agreement with the Fort Collins-Loveland Water District for
the sale of treated water to the District, with said agreement to continue until
December 31, 2006, and with Lhe District to have the option to extend said
agreement for an additional fifteen (15) years. The District shall provide the
City with a volume of raw water equal to the quantity of treated water delivered
by the City to the District, and the District shall pay the City fifty cents
($0.50) per one thousand (1,000) gallons of treated water for the year 1991, with
said rate to be adjusted in subsequent years based upon rate factors calculated
to fully compensate the City for its costs in treating and delivering the water
to the District.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 18th day of December, A.D. 1990.
