OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL
AGREEMENT WITH THE CITY OF LOVELAND FOR THE JOINT OPERATOR
OF THE FORT COLLINS LOVELAND MUNICIPAL AIRPORT
WHEREAS, the Fort Collins Loveland Municipal Airport ("Airport") is
jointly owned by the City of Fort Collins ("Fort Collins") and the City of
Loveland ("Loveland") ; and
WHEREAS, from time to time Loveland and Fort Collins have entered into
agreements concerning the operation, financing and planning of the Airport; and
WHEREAS, the Cities wish to enter into a new agreement to restate, revise
and clarify certain particulars with regard to the continuing management of their
joint asset.
WHEREAS, Section 29-1-203, C.R.S. , authorizes the Cities to cooperate and
contract with one another and other governmental agencies in order to provide
any function, service or facility lawfully authorized to each if such contract
is properly authorized by each party thereto; and
WHEREAS, Article II, Section 16 of the Charter of the City of Fort Collins
authorizes the Council , by ordinance or resolution, to enter into contracts with
other governmental bodies to furnish governmental services or enter into
cooperative or joint activities with other governmental bodies.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the Mayor be, and she hereby is, authorized to enter into an
intergovernmental agreement between the City of Fort Collins and the City of
Loveland addressing the joint management of the Fort Collins - Loveland Airport
and including the following terms:
Section 1 . Full management and policy making authority shall be vested
equally in both Cities, jointly exercised through their respective City Managers.
Section 2. That the Agreement will run for a term of two (2) years.
Section 3. That an Airport Manager will be employed to serve at the
pleasure of both City Managers and to supervise all operations and activities
of the Airport.
Section 4. That each City will review annual operating and capital budget
requests submitted on behalf of the Airport.
Section 5. That, subject to available funds, the Cities will provide equal
funding for those expenditures they authorize for the Airport.
Section 6. That the Cities will provide administrative support services
to the Airport and the Airport Manager.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 4th day of December, A.D. 1990.
