OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE ACQUISITION OF ADDITIONAL STREET
MAINTENANCE SERVICES AS A CHANGE ORDER
TO THE 1990 STREET MAINTENANCE CONTRACT
WHEREAS, the City of Fort Collins and Western Mobile/Northern Construction
Company have entered into a contract to construct the improvements associated
with the City's 1990 Street Maintenance Program; and
WHEREAS, the Council hereby finds that additional and/or revised
maintenance is required on certain City streets already included in said
contract; and
WHEREAS, the Council hereby finds that additional streets in the City,
Horsetooth Road from Richmond to Dunbar and Shields Street from Troutman to
Horsetooth, are in need of rehabilitation; and
WHEREAS, present competitive market conditions indicate significant cost
savings in performing said rehabilitation in connection with the 1990 Street
Maintenance Program; and
WHEREAS, sufficient funds to perform said additional work are available
and appropriated in the 1990 Street Maintenance Program fund; and
WHEREAS, Section 8-160(d) (1) (j) of the Code of the City of Fort Collins
authorizes the award of a contract for maintenance services without competition
when the maintenance service is the subject of a change order; and
WHEREAS, the Purchasing Agent has determined in writing that this purchase
is within the purview of this exception to the competitive sealed bidding and/or
proposal requirements of the City Code and Charter and has submitted the
determination to the City Manager for approval ; and
WHEREAS, the City Manager has reviewed and approved the determination for
this change order; and
WHEREAS, Section 8-160(d) (3) requires the City Manager to submit all
procurements under this subsection which exceed a cost of Fifty Thousand Dollars
($50,000) to the City Council in an open meeting for final approval ; and
WHEREAS, in addition, the City's Capital Projects Procedures Manual
requires that change orders in excess of $50,000 be approved by the City Council .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the acquisition of street maintenance services as a change order to the
contract with Western Mobile/Northern Construction Company for the rehabilitation
of Horsetooth Road from Richmond to Dunbar and Shields Street from Troutman to
Horsetooth at a cost not to exceed Five Hundred Seventy-one Thousand Three
Hundred Dollars ($571,300) is hereby approved.
Passed and adopted at a regular meeting of the City Council held this 16th
day of October, A.D. 1990. /
