OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO EXECUTE AN
INTERGOVERNMENTAL AGREEMENT WITH LARIMER COUNTY
REGARDING THE TRANSFER OF EXXON GRANT FIXED ASSETS
WHEREAS, as a part of the City's entitlements pursuant to its Exxon
Overcharge Grant, the City obtained a truck, trailer, and thirty-eight (38)
front-load containers; and
WHEREAS, the pilot recycling program which was conducted by the City
under the Exxon Grant has been completed; and
WHEREAS, the City no longer needs, for recycling purposes, the truck,
trailer and front-load containers; and
WHEREAS, said equipment can be productively utilized by Larimer County
for the purpose of encouraging recycling both at the Larimer County
Landfill and at remote recycling drop-off facilities at Berthoud, Red
Feather Lakes and Wellington; and
WHEREAS, the City Council has determined that it is in the best
interest of the City to encourage recycling county wide in order to reduce
the waste stream entering the landfill , of which the City is part owner;
and
WHEREAS, in furtherance of recycling in Larimer County, the Council
has determined that it is in the best interest of the City to conditionally
transfer ownership and title to the truck, trailer and front-load
containers to Larimer County for the limited purpose of utilization by the
county in its recycling program.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor be, and she hereby is, authorized to execute an
intergovernmental agreement with Larimer County for the purpose of
transferring title and ownership of the truck, trailer and front-load
containers obtained by the City under the City's Exxon Overcharge Grant to
the county upon condition that the county utilize said equipment only for
recycling purposes as part of the county's recycling program, and for no
other purpose, and that the county adequately insure said equipment and
maintain it in good working condition.
Passed and adopted at a regular meeting of the City Council held this
3rd day of July, A.D. 1990.
