OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN
INTERGOVERNMENTAL AGREEMENT WITH THE
FORT COLLINS-LOVELAND WATER DISTRICT FOR
THE SALE OF DRINKING WATER
WHEREAS, the Fort Collins-Loveland Water District (the District)
desires to purchase additional treated water from the City in order to meet
the District's projected water demands; and
WHEREAS, the Water Utility of the City has determined that the sale of
said additional treated water to the District would not detrimentally
affect the ability of the City's Water Utility to supply treated water to
its customers; and
WHEREAS, under the terms of the proposed agreement, the City would
sell not more than three million gallons of water per day to the District
for the period of time commencing June 1 , 1990, and terminating November 1 ,
1993; and
WHEREAS, the agreement further provides that the District shall pay to
the City 51.5 cents for each one thousand gallons of drinking water
delivered to the District with the City retaining the right to increase the
amount charged in order to fully compensate the City for the cost of
providing said water to the District; and
WHEREAS, the agreement further provides that the District shall
provide the City with sufficient raw water, from Horsetooth Reservoir, to
equal the quantity of drinking water delivered to the District by the City
and that the District shall be responsible for the cost of design and
installation of any additional equipment or facilities necessary for the
District to connect to the City's system; and
WHEREAS, the Council has further determined that the City should enter
into said agreement with the District.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor be, and she hereby is, authorized to enter into an
Intergovernmental Agreement with the Fort Collins-Loveland Water District
for the sale of drinking water upon the terms and conditions described
above.
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 15th day of May, A.D. 1990.
