HomeMy WebLinkAbout1996-035-03/05/1996-LEGISLATIVE AGENDA PUBLIC RIGHTS OF WAY SB 10 SB 187 SENATE BILL 10 SENATE BILL 187 TAX TELECOMMUNIC RESOLUTION 96-35 OF THE COUNCIL OF THE CITY OF FORT COLLINS RELATING TO THE CITY'S OPPOSITION TO STATE SENATE BILLS 10 AND 187 WHICH CONCERN A MUNICIPALITY'S RIGHT TO CHARGE TELECOMMUNICATION PROVIDERS FOR THE USE OF PUBLIC RIGHTS OF WAY AND TO TAX TELECOMMUNICATION PROVIDERS AND THEIR PRODUCTS WHEREAS, on December 5, 1995, the Fort Collins City Council ("the Council") adopted the City's 1996 Legislative Agenda in Resolution 95-166; and WHEREAS, on pages 16 and 17 of its 1996 Legislative Agenda, the Council makes policy statements in support of "...legislation that preserves the City's authority to grant franchises to companies providing telecommunications services.., legislation that requires telecommunications providers to pay appropriate fees for the use of public rights of way.., [and] legislation that excludes prohibitions on local taxing or fee authority related to alternative video systems"; and WHEREAS, there is currently pending in the Colorado General Assembly Senate Bills 10 and 187, both of which would significantly restrict, if not eliminate, the City's ability to charge telecommunication companies a reasonable fee for such companies' use of the City's rights of way and would further restrict the City's ability to tax telecommunication providers and their products; and WHEREAS, the purposes and effects of Senate Bills 10 and 187 run contrary to the said policy statements of the Council in its 1996 Legislative Agenda; and WHEREAS, the Council has determined that it is in the best interests of the City and consistent with its 1996 Legislative Agenda to oppose the passage of Senate Bills 10 and 187. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS,that it opposes passage of Senate Bill 10 and Senate Bill 187 as they would adversely and unfairly affect the City's ability to charge telecommunication providers a reasonable fee for the use of the City's rights of way and to tax telecommunication providers and their products.
