HomeMy WebLinkAbout1993-017-02/02/1993-BUS PARKING LEASE MCGRAW ELEMENTARY SCHOOL POUDRE R-1 SCHOOL DISTRICT RESOLUTION 93-17 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO ENTER INTO A LEASE OF CITY PROPERTY TO THE POUDRE R-1 SCHOOL DISTRICT FOR BUS PARKING PURPOSES WHEREAS, pursuant to Resolution 91-140, the City has purchased a ten-acre park site adjacent to the new McGraw Elementary School ("the Property") ; and WHEREAS, the City entered into a lease of the Property to the Poudre School District R-1 ("the District") through February 26, 1993, pursuant to Resolution 92-106; and WHEREAS, the District has requested that the lease of the Property be extended from February 26, 1993, through June 30, 1994; and WHEREAS, the City does not anticipate a need or use for the Property prior to July of 1994; and WHEREAS, the City wishes to cooperate with the District by allowing the District to use a portion of this Property for bus and tractor parking and storage through June of 1994; and WHEREAS, the City wishes to receive the benefit of having the District maintain the Property; and WHEREAS, Article II, Section 16, of the City Charter provides that the City Council may, by ordinance or resolution, enter into contracts with other governmental bodies to furnish governmental services and to make charges for such services or to enter into cooperative or joint activities. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be, and hereby is, authorized to extend the term of the intergovernmental agreement between the City and the District to lease to the District the Property described on the attached Exhibit A for the purpose of parking up to seventeen (17) buses from February 1993 through June 30, 1994, for the rental amount of Ten Dollars ($10.00) , with the District to maintain the Property at its expense and pay for all utilities used thereon. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 2nd day of February, A.D. 1993. Mayor ATTEST: City Clerk EXHIBIT A DESCRIPTION OF THE TOTAL PARK SITE A tract of land located in the North one half of Section 2 Township 6 North, Range 69 West of the Sixth Principal Meridian, City of Fort Collins, Larimer County, Colorado, being located within that certain tract of land as described in the deed recorded in Book 1450 at Page 163 records of the Clerk and Recorder of the said Larimer County, more particularly described as follows; Considering the line between the northwest corner of the said Section 2 (being a found aluminum cap monument stamped LS 5028) , and the north one quarter corner of the said Section 2 (being a found aluminum cap monument stamped LS 5028) being the North line of the northwest one quarter of the said Section 2 , as bearing North 89 degrees 47 minutes 49 seconds East and with all bearings contained herein relative thereto; Commencing at the said northwest corner of the said Section 2 , thence along the said north line, North 89 degrees 47 minutes 49 seconds East for a distance of 2338. 56 feet to the northerly prolongation of the proposed easterly right of way of Hinsdale Drive; THENCE along the said northerly prolongation, and along the said proposed right of way, South 00 degrees 12 minutes 11 seconds East for a distance of 180. 00 feet; THENCE continuing along the said proposed right of way, along a curve to the left having a radius of 800.00 feet, an arc length of 139 . 63 feet and a central angle of 10 degrees 00 minutes 00 seconds, being subtended by a chord of South 05 degrees 12 minutes 11 seconds East for a distance of 139 . 45 feet; THENCE continuing along the said proposed right of way, along a curve to the right having a radius of 1314 . 40 feet, an arc length of 53 . 93 feet and a central angle of 02 degrees 21 minutes 04 seconds being subtended by a chord of South 09 degrees 01 minutes 39 seconds East for a distance of 53 .93 feet to the TRUE POINT OF BEGINNING of this description; THENCE continuing along the said proposed right of way, along a curve to the right having a radius of 1314 . 40 feet an arc length of 391.47 feet and a central angle of 17 degrees 03 minutes 52 seconds being subtended by a chord of South 00 degrees 40 minutes 49 seconds West for a distance of 390. 03 feet; THENCE South 89 degrees 58 minutes 41 seconds East for a distance of 652 . 33 feet; THENCE along a line which is parallel with the right of way of Crest Road, as shown on the plat of Brookwood Estates, a Plat of record with the said Clerk and Recorder, South 00 degrees 01 minutes 19 seconds West for a distance of 510. 01 feet to the northerly line of Lot 9 of the said plat of Brookwood Estates; THENCE along the said northerly line, North 89 degrees 09 minutes 59 seconds East for a distance of 220 . 02 feet; THENCE again parallel with the said right of way of Crest Road, North 00 degrees 01 minutes 19 seconds East for a distance of 896.72 feet; THENCE North 89 degrees 58 minutes 41 seconds West for a distance of 867 .85 feet to the point of beginning. The above described tract contains 10. 271 acres or 447389 square feet and is subject to all easements and rights of ways now existing or of record. I hereby state that the above description was prepared by me and is true and correct to the best of my professional knowledge, belief and opinion.
