HomeMy WebLinkAbout1993-011-01/19/1993-AGREEMENT OF SALE AND PURCHASE ENGLISH RANCH NEIGHBORHOOD PARK PARKLAND FUND PARKLAND PROPERTY RESOLUTION 93-11 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT OF SALE AND PURCHASE TO PURCHASE PARKLAND PROPERTY WHEREAS, the Council of the City of Fort Collins has adopted the Parks and Recreation Master Plan which recommends one neighborhood park per square mile in residential areas of the City; and WHEREAS, the Council has appropriated money in the Parkland Fund for the purpose of purchasing neighborhood parks in residential areas; and WHEREAS, the City wishes to purchase certain property known as the English Ranch for a neighborhood park, because it is located near the center of a residential section and meets the Master Plan criteria for the location of neighborhood parks; and WHEREAS, the current owner has agreed to sell 5.4739 acres of said property for a price of $90,481 .60 to the City for the purpose of a neighborhood park site; and WHEREAS, the City has determined that the foregoing sales price represents the fair market value of the property, based on sales of comparable properties reviewed by the City's Right-of-way Agent. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager be, and hereby is, authorized to enter into an Agreement of Sale and Purchase to purchase property known as the English Ranch Park site, comprising approximately 5.4739 acres located near Linton Elementary School and more particularly described on attached Exhibit "A, " which is incorporated herein by this reference, for a sum of Ninety Thousand Four Hundred Eighty-One Dollars and Sixty Cents ($90,481 .60) . Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 19th day of January, A.D. 1993. Mlyor ATTEST: w�zl City Clerk Exhibit A Legal Description A tract of land situate in the Northeast 1/4 of Section 32, Township 7 North, Range 68 West of the Sixth P.M. , City of Fort Collins, County of Larimer, State of Colorado, which, considering the West line of said Northeast 1/4 as bearing N 00° 09' 23" W and with all bearings contained herein relative thereto is contained within the boundary lines which begin at a point on said West line which bears S 00° 09' 23" E 1359.29 feet from the North 1/4 Corner of said Section 32, and run thence S 89° 34' 07" E 153.00 feet; thence N 73° 02' 00" E 367.00 feet; thence N 83° 22' 00" E 85.72 feet; thence S 06° 38' 00" E 240.88 feet; thence along the arc of a 1012.86 foot radius curve to the right a distance of 131 .38 feet, the long chord of which bears S 02' 55' 03" E 131 .28 feet; thence S 006 47' 54" W 89.86 feet, thence N 89° 12' 06" W 621 .57 feet to a point on the West line of said Northeast 1/4; thence along said West line, N 00' 09' 23" W 335.73 feet to the point of beginning, containing 5.4739 acres, more or less.
