RESOLUTION 94-19
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE PURCHASE OF AN ENERGY MANAGEMENT SYSTEM

FROM JOHNSON CONTROLS INCORPORATED
WHEREAS, Johnson Control 's Energy Management System (EMCS) was selected as
the standard for City buildings by a competitive process in 1983; and
WHEREAS, the EMCS is needed for the new Senior Center building; and
WHEREAS, sufficient funds have been budgeted and approved in the Senior
Center capital project budget to procure the EMCS for the Senior Center project;
and
WHEREAS, Section 8-160(d) (1)c. of the Code of the City of Fort Collins
authorizes the Purchasing Agent to negotiate the purchase of materials and
service without utilizing a competitive process where the Purchasing Agent
determines that a particular material or service is required to maintain
interchangeability or compatibility as a part of an existing integrated system;
and
WHEREAS, the purchase of the EMCS for the new Senior Center is required to
maintain compatibility with the City's existing EMCS system; and
WHEREAS, the Purchasing Agent has submitted the requisite justification to
the City Manager for approval ; and
WHEREAS, the City Manager has reviewed and approved the justification for
this acquisition; and
WHEREAS, Section 8-160(d) (3) requires approval of this purchasing method
by the City Council for items costing more than Fifty Thousand Dollars ($50,000)
prior to acquisition.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT
COLLINS that the Purchasing Agent is authorized to purchase, without a
competitive process, the EMCS for the new Senior Center from Johnson Controls
Incorporated for the amount of Ninety Thousand Four Hundred Dollars ($90,400) .
Passed and adopted at a regular meeting of the City Council held this 18th
day of January, A.D. 1994.
