HomeMy WebLinkAbout1993-104-07/06/1993-CONTIGUITY FOX HILLS PUD OFF-SITE STREET IMPROVEMENTS UGA PUBLIC STREET CAPACITY WAIVER RESOLUTION 93-104 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING WAIVERS FROM THE UGA PUBLIC STREET CAPACITY REQUIREMENT TO CONSTRUCT OFF-SITE STREET IMPROVEMENTS AND FOR CONTIGUITY TO EXISTING DEVELOP T FOR FOX HILLS PRELIMINARY PUD WHEREAS, Section II, Paragraph 5 (b) of the Interg ernmental Agreement between the City of Fort Collins and Lorimer County for t establishment of the Fort Collins Urban Growth Area provides that the City Council shall have the right to review and comment upon development propo is which propose waiver requests to the phasing criteria for development in t e Fort Collins Urban Growth Area; and WHEREAS, Larimer County has forwarded to he City Council for review and comment the waiver requests for the "Fox Hill Preliminary PUD", whereby it has been requested that waivers be granted with r spect to the public street capacity requirement and contiguity to existing dev opment, as set forth in the aforesaid Intergovernmental Agreement; and WHEREAS, the "Fox Hills Prelimi ary PUD" is located within the Urban Growth Area and qualifies as "infill " dev opment within the meaning of the aforesaid Intergovernmental Agreement. NOW, THEREFORE, BE IT R OLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Council hereby reco ends to the Board of County Commissioners that the requirements of the Intergo ernmental Agreement for the establishment of the Fort Collins Urban Growth Are ith respect to public street capacity and contiguity to existing developme as defined in the Larimer County Supplemental Regulations, be waive as those requirements are or may be applicable to the "Fox Hills Preliminary P " and that the waiver fee of Seven Hundred Dollars ($700) per additional lot a collected with building permits.
