HomeMy WebLinkAbout1993-103-07/06/1993-CUNNINGHAM BARN CUNNINGHAM CORNER PUD NATIONAL REGISTER RFP SID #82 RESOLUTION 93-103 OF THE COUNCIL OF THE CITY OF FORT COLLINS REGARDING THE DISPOSITION OF THE CUNNINGHAM BARN WHEREAS, on June 5, 1984, the Council of the City of Fort Collins (the "Council ") authorized the creation of the Cunningham Corner Special Improvement District #82 (the "District") for the purpose of installing street, water, and wastewater improvements within the District; and WHEREAS, the owner of a tract designated for commercial use in Cunningham Corner PUD which is generally described on Exhibit "A" attached hereto and incorporated here in by this reference as (the "Property") failed to pay the first assessment installment due in October of 1988; and WHEREAS, the City subsequently obtained a deed in lieu of foreclosure from the owner of the Property; and WHEREAS, Section 22-97(d) of the Code provides, that, if the City is the owner of property acquired in satisfaction or discharge of liens represented by certificates of purchase, it may sell such property for the best price obtainable at public sale or auction or by sealed bids or by such other method of sale which may be approved by the City Council ; and WHEREAS, the Property includes a structure known as the Cunningham Barn (the "Barn") which is eligible for listing on the National Register of Historic Places; and WHEREAS, the City began marketing the Property in May of 1992 and has not received any acceptable bids which include restoration of the Barn on site; and WHEREAS, in order to maximize the sales price for the Property the City must remove the Barn from the Property; and WHEREAS, the Landmark Preservation Commission has discussed the future of the Barn and recommends that the Barn be moved to public property for future rehabilitation; and WHEREAS, funds have previously been appropriated by the Council for historic preservation purposes; and WHEREAS, several citizens have expressed an interest in relocating the Barn to private property; and WHEREAS, the Council of the City of Fort Collins has determined it is in best interests of the citizens of Fort Collins to move the Barn to private property. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Barn be relocated to private property within the Urban Growth Area. Section 2. That an RFP be issued to identify those parties interested in obtaining the Barn for private use and to select an appropriate site for the Barn. Section 3. That the relocation of the Barn be funded from 'the Historic Preservation Account within the Capital Projects Fund.
