HomeMy WebLinkAbout1992-088-05/19/1992-CITY OF LOVELAND FAA FIRE STATION FORT COLLINS/LOVELAND AIRPORT IGA RESOLUTION 92- 88 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF LOVELAND AUTHORIZING THE ESTABLISHMENT OF A FIRE STATION AT THE FORT COLLINS-LOVELAND MUNICIPAL AIRPORT WHEREAS, Loveland and Fort Collins are the owners and operators of the Fort Collins-Loveland Municipal Airport ("Airport") and have entered into an Intergovernmental Agreement for the Joint Operation of the Fort Collins-Loveland Municipal Airport dated January 9, 1990 ("the Intergovernmental Agreement") ; and WHEREAS, the Airport has been annexed into Loveland, and Loveland desires to establish a fire station in order to better meet the municipal obligation of Loveland to provide fire protection to the Airport and the immediately surrounding area; and WHEREAS, Loveland and Fort Collins desire to improve the provision of fire, crash and rescue service for aeronautical activities at the Airport, and for such purpose, have applied to the Federal Aviation Administration ("FAA") for a grant; and WHEREAS, Loveland desires to avail itself of certain efficiencies which can be realized by planning, building, operating and maintaining joint fire station facilities that meet Airport, as well as Loveland's municipal , obligations from one location on the Airport property; and WHEREAS, pursuant to the Intergovernmental Agreement, both Loveland and Fort Collins reserve the right to invest additional funds in the Airport as each city sees fit, provided that any improvements to the real and personal property resulting from such single party investments shall be and remain an asset of the investor which shall become vested in the purchasing city; and WHEREAS, said Intergovernmental Agreement also requires the Airport Manager to maintain and repair all Airport buildings; and WHEREAS, the parties desire to amend said Intergovernmental Agreement to the extent that the Airport Manager shall not have the obligation to maintain and repair that portion of the fire station which is set aside for the exclusive use of Loveland; and WHEREAS, the parties further desire to specify that portion of the fire station facility which is to be held for the exclusive use of Loveland, and to specify how Loveland's vested interest shall be recognized and how Loveland shall be compensated for its vested interest in the event of a sale or other disposition of said fire station property; and WHEREAS, Article II, Section 16 of the City Charter authorizes the Council , by ordinance or resolution, to enter into cooperative or joint activities with other governmental bodies. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be, and hereby is, authorized to execute an Amendment to the Intergovernmental Agreement with the City of Loveland regarding the construction, ownership and operation of a fire station upon property located at the Fort Collins-Loveland Municipal Airport, which fire station shall be partially funded by the FAA and utilized for airport purposes and partially funded by the City of Loveland and utilized for its municipal purposes, and that said Amendment shall be upon such terms and conditions as, in the judgment of the City Manager, will accomplish the purposes set forth in the recitals of this Resolution.
