HomeMy WebLinkAbout1994-150-09/06/1994-BRANCH LIBRARY COLLEGE PUBLIC LIBRARY FRONT RANGE COMMUNITY COLLEGE IGA JOINT COMMUNITY LIBRARY LEAS RESOLUTION 94-150 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT FRONT RANGE COMMUNITY COLLEGE TO OPERATE A JOINT COMMUNITY/COLLEGE PUBLIC LIBRARY WHEREAS, the City desires to open a branch library in the south part of Fort Collins in order to provide improved library services to the citizens of Fort Collins; and WHEREAS, Front Range Community College, ("the College") , wishes to combine the College's campus library with the Fort Collins branch library in order to provide better library services to the College's students, faculty and staff; and WHEREAS, by combining their resources, the City and the College can provide better library services less expensively than if the services were provided by the City and the College separately; and WHEREAS, the City and the College would like to develop a site on the College's Larimer County campus for the branch library and would also like to acquire a modular building approximately 6500 square feet in size to be placed on the site to be used as the joint library; and WHEREAS, the City and the College wish to jointly operate the library for the benefit of the public and the students, faculty and staff of the College; and WHEREAS, Section 29-1-203, C.R.S. , and Article II, Section 16, of the City Charter authorize the City to cooperate and contract with other governmental entities in order to provide any function, service or facility lawfully permitted to each if such a contract is properly authorized by each party. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor is hereby authorized to enter into an intergovernmental agreement with the College to develop, operate, maintain and use a joint community college/public library; and said intergovernmental agreement shall provide as follows: a. That the College will provide a site for the joint library on the College's Larimer Campus for a period of ten (10) years. b. That the City will procure, through a lease/purchase, the development of the library site and a modular building for the library approximately sixty-five hundred (6500) square feet in size. C. That the City and the College will cooperate in the operation and rrrai-trtendnLL- oT ttrL- jui-nt library sv as tu- provide the most beneficial library services to the public and to the College's students, faculty and staff. d. That the City shall pay for sixty (60), percent of the costs ,to develop the library site, acquire the library building and other customary costs associated with the operation and maintenance of the joint library, and the College will pay forty (40) percent of these costs; and that the parties may adjust their percentage of costs for the joint library annually based on customer use. e. That the City and the College shall assemble an advisory committee to make recommendations to the City and the College concerning their operation of the joint library. f. That the agreement shall provide for all other matters necessary to allow for the parties to develop, operate, use and maintain the joint library to provide the most beneficial library services to the public and to the College's students, faculty and staff. g. That the Mayor is authorized to modify and amend the intergovernmental agreement with the College, provided such amendments or modifications are consistent with items (a) through (f) above.
