HomeMy WebLinkAbout1994-131-08/16/1994-7100 SOUTH LEMAY ALLOTMENT CONTRACT CBT WATER NCWCD SOUTH LEMAY SID NO. 86 TEMPORARY USE PERMIT RESOLUTION 94-131 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING AN APPLICATION FOR A TEMPORARY USE PERMIT WITH THE NORTHERN COLORADO WATER CONSERVANCY DISTRICT FOR 50 UNITS OF COLORADO-BIG THOMPSON WATER WHEREAS, the City of Fort Collins ("the City") recently acquired title to a parcel of land commonly known as 7100 South Lemay ("the Property") ; and WHEREAS, the City acquired title to the Property through the issuance of a Treasure's Deed to the City arising from the tax sale of the Property due to the non-payment of assessments owed to the South Lemay Special Improvement District No. 86 ("the Special Improvement District") ; and WHEREAS, as a consequence of the City acquiring title to the Property, the City also acquired ownership of a Class D Allotment Contract of fifty (50) acre- foot units of Colorado-Big Thompson water ("the CBT water") which is attached to the Property; and WHEREAS, in order to perfect the City's title to the CBT water, it is necessary for the City to file with the Northern Colorado Water Conservancy District ("the NCWCD") an Application for Change of Class D Allotment Contract, an application for a Temporary Use Permit, and an Ownership Report certifying that the City owns fee title to the Property; and WHEREAS, once the City's title to the CBT water is so perfected, the CBT water will be transferred to the City's Water and Wastewater Utility which will pay to the City's Finance Department the fair market value of CBT water so that such monies can be applied to the reduction of the bond indebtedness owed by the Special Improvement District. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager be, and hereby is, authorized to file with the NCWCD an Application for Change of Class D Allotment Contract and an application for a Temporary Use Permit for the CBT Water; and that the City Attorney, or his designee, is further authorized to execute the Ownership Report required by NCWCD certifying that the City owns fee title to the Property.
