HomeMy WebLinkAbout1989-074-03/21/1989-AUTHORIZING A WAIVER OF THE PUBLIC SEWER CAPACITY REQUIREMENTS AND A WAIVER FROM THE 1/6TH CONTIGUIT RESOLUTION 89-74 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING A WAIVER OF THE PUBLIC SEWER CAPACITY REQUIREMENTS AND A WAIVER FROM THE 1/6TH CONTIGUITY REQUIREMENT FOR THE COLLAMER SPECIAL REVIEW WHEREAS, Section II, Paragraph 5(b) of the Intergovernmental Agreement between the City of Fort Collins and Larimer County for the establishment of the Fort Collins Urban Growth Area provides that the City Council shall have the right to review and comment upon development proposals which propose waiver requests to the public sewer standards and contiguity requirements as defined in the Larimer County Supplemental Regulations; and WHEREAS, Larimer County has forwarded to the City Council for review and comment the waiver request for the "Collamer Special Review, " whereby it has been requested that a waiver be granted with respect to the public sewer capacity requirements and the 1/6th contiguity requirements as set forth in the aforesaid Intergovernmental Agreement; and WHEREAS, the "Collamer Special Review" is located within the Urban Growth Area and is proposed to be serviced by infrastructure provided by the City of Greeley Department of Water, the Public Service Company of Colorado and the Poudre Valley Rural Electric Association; and WHEREAS, the "Collamer Special Review" has been determined by the Council to qualify as "infill " development in accordance with the aforesaid Intergovernmental Agreement, and, therefore, is eligible for entitlement to the waiver of the requirement of 1/6th contiguity with existing development and the requirement that the property be served by a public sewer system. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Council hereby recommends to the Board of County Commissioners that the requirements of the Intergovernmental Agreement for the establishment of the Fort Collins Urban Growth Area with respect to the public sewer standards and contiguity requirements, as defined in the Larimer County Supplemental Regulations, be waived as those requirements are or may be applicable to the "Collamer Special Review" ; provided that said waiver be conditioned upon the applicant/developer entering into a written agreement with the County, naming the City as a third party beneficiary thereof, whereby said applicant/developer promises to financially participate in the future extension of sewer service to the property and the general vicinity of the property, through such means as the City may reasonably determine, including, without limitation, participation in a special improvement district.
