HomeMy WebLinkAbout1994-072-05/03/1994-NEIGHBORHOOD PARK POUDRE R-1 SCHOOL DISTRICT PURCHASE 10.21 ACRES SOUTHEAST JUNIOR HIGH SCHOOL RESOLUTION 94-72 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE ACQUISITION OF LAND FROM THE POUDRE R-1 SCHOOL DISTRICT FORTH E DFY_ELOPMENT OF A NElfHRORHODa PARK- WHEREAS, the Council of the City of Fort Collins has adopted a policy of providing a neighborhood park for every predominantly residential square mile of the City; and WHEREAS, the Council has also adopted a policy of cooperating with the Poudre R-1 School District in the acquisition and development of recreational facilities; and WHEREAS, 10.21 acres of land adjacent to the new Southeast Junior High School are available for purchase to be developed as a neighborhood park; and WHEREAS, sufficient funds have previously been budgeted and appropriated for the acquisition of this property for park purposes. NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager is hereby authorized to enter into an agreement with the Poudre R-1 School District for the purchase of 10.21 acres of land adjacent to the New Southeast Junior High School (described on Exhibit "A, " which is attached hereto and incorporated herein by this reference) for a price not to exceed One Hundred Fifty-eight Thousand Two Hundred Fifty-five Dollars ($158,255. ) for the development of a neighborhood park. Passed and adopted at a regular meeting of the Co '1 of the City of Fort Collins held this 3rd day of May, A.D. 1994. AUF6r ATTEST: City Clerk EXHIBIT "A" DESCRIPTION A tract of land located in the Northeast Quarter of Section 5, Township 6 North, Range 68 West of the 6th Principal Meridian, City of Fort Collins, Larimer County, Colorado, being more particularly described as follows: Considering the North line of the Northeast Quarter of said Section 5 as bearing, South 89022'33" East from a 3/4" iron pipe at the North Quarter corner of said Section 5 and with all bearings contained herein relative thereto:, Commencing at the North Quarter corner of said Section 5: thence along the West line of the Northeast Quarter, South 00°46'37" East, 2049.50 feet to the POINT OF BEGINNING; thence continuing along said West line, South 00046137" East, 336.35 feet to a point on the North line of a tract of land described in Book 540, Page 105, Larimer County Records; thence along said North line, South 89°44'14" East, 1375.82 feet; thence, North 00015'46" East, 265.25 feet; thence, North 89°44'14" West, 128.56 feet to a point on a curve concave to the Northeast having a central angle of 39°06'51", a radius of 317.00 feet and the chord of which bears North 70°10'49" West, 212.23 feet; thence along the arc of said curve 216.41 feet; thence, North 89°44'14" West, 1053.38 feet to the Point of Beginning. The above described easement contains 10.213 acres and is subject to all easements and rights-of-way now on record or existing.
