OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING AN INTERGOVERNMENTAL AGREEMENT TO BE
ENTERED INTO WITH THE COLORADO DEPARTMENT OF TRANSPORTATION
PROVIDING FOR THE MAINTENANCE OF ROADWAYS WITHIN
THE CITY BY THE CITY AND PAYMENT THEREFOR BY
THE COLORADO DEPARTMENT OF TRANSPORTATION
WHEREAS, the Colorado Department of Transportation has prepared and
presented to the City an agreement providing for the City to maintain 7.60 miles
of the state highway system within the city limits; and
WHEREAS, the City has entered into previous intergovernmental agreements
with the Colorado Department of Transportation providing for the maintenance of
state highways within the city, and no problems have developed from those
agreements; and
WHEREAS, Colorado law and the City Charter authorize governments to enter
into contractual agreements with one another for the purpose of cooperating
together in joint activities; and
WHEREAS, the Council has determined that it is in the best interests of the
City that an agreement be entered into with the State of Colorado providing for
the maintenance of state highways within the city and payment therefor by the
State.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the Mayor be, and hereby is, authorized and directed to execute an
intergovernmental agreement for and on behalf of the City of Fort Collins, which
agreement shall provide for the maintenance by the City of 7.60 miles of the
state highway system within the city limits and payment therefor by the State at
a rate of One Thousand Nine Hundred Fifty Dollars ($1,950) per mile per fiscal
year.
Passed and adopted at a regular meeting of the Council of the City of Fort
Collins held this 5th day of April , A.D. 1994.
