HomeMy WebLinkAbout1998-120-08/18/1998-APPROVING PURCHASE OF A 1998 GILLIG TRANSIT BUS FROM GILLIG CORPORATION AS AN EXCEPTION TO THE COMPE RESOLUTION 98-120 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE PURCHASE OF A 1998 GILLIG TRANSIT BUS FROM THE GILLIG CORPORATION AS AN EXCEPTION TO THE COMPETITIVE PURCHASING PROCESS WHEREAS, Transfort needs a new bus for Foxtrot and, based on the fact that the delay in funding for that bus was not foreseen,had planned on having a new bus available for this service in 1998; and WHEREAS,Gillig has voluntarily kept the bus under construction and reserved for the City, pending completion of the funding process; and WHEREAS, sufficient funds for the purchase have been provided by a combination of Colorado Department of Transportation Section 5311 grant and local matching funds,appropriated by Council in Ordinance No. 115, 1998; and WHEREAS, Section 8-160 (d) (1) b of the Code of the City of Fort Collins authorizes the Purchasing Agent to negotiate the purchase of supplies and service without utilizing a competitive process where the Purchasing Agent determines that although a particular material or service is available from more than one (1) responsible source, a competitive process cannot reasonably be used,or, if used,will result in a substantially higher cost to the City,will otherwise injure the City's financial interests or will substantially impede the City's administrative functions or the delivery of services to the public; and WHEREAS, because of the lengthy delay which would be involved in starting the procurement process over,the Purchasing Agent has determined that a competitive process cannot reasonably be used and,if used,would result in a substantially higher cost to the City and may result in the impairment of the City's delivery of services to the public, and the Purchasing Agent has submitted the requisite justification for this determination to the City Manager for approval; and WHEREAS, the City Manager has reviewed and approved the justification for this acquisition; and WHEREAS, Section 8-160 (d) (3)requires approval of this purchasing method by the City Council for items costing more than One Hundred Thousand Dollars($100,000)prior to acquisition. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS that the Purchasing Agent is authorized to purchase a 1998 Gillig bus in the amount of$228,406 as an exception to the competitive purchasing process requirements.
