OF THE COUNCIL OF THE CITY OF FORT COLLINS
MAKING AN AMENDMENT TO THE BOARDS AND COMMISSIONS
MANUAL AS IT RELATES TO MEMBERSHIP LIMITATIONS
WHEREAS, the City currently has several boards and commissions appointed by the City
Council; and
WHEREAS, the City's rules and regulations pertaining to membership on said boards and
commissions are established by the City Council; and
WHEREAS, said rules and regulations are contained in a Boards and Commission Manual
(the "Manual) maintained by the City Clerk, which Manual was adopted the City Council by
Resolution 90-110; and
WHEREAS,the Manual presently provides on Page 43 that"no person will be appointed for
membership to any board or commission who is not a resident of Fort Collins or the Fort Collins
Urban Growth Area"; and
WHEREAS, a question has arisen as to whether this requirement is intended to apply only
at the time of the appointment of a board or commission member,or during the entire term of service
of board or commission members; and
WHEREAS, said provision has historically been interpreted to require appointed members
of boards and commissions to maintain residency within the Fort Collins Urban Growth Area during
the entire term of appointment; and
WHEREAS, Council wishes to clarify said policy to state that members must maintain
residency within the Fort Collins Urban Growth Area during the entire term of appointment, and that
a vacancy is created when a board or commission member moves his or her place of residence
outside of the Urban Growth Area.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the 1994-95 Boards and Commissions Manual of the City, and all
subsequent editions thereof, shall be, and hereby is, modified in the following respect:
Under "General Information" appearing on page 43 of the Manual, the section
pertaining to Membership Limitations shall read in its entirety as follows:
Membership 1.imitations\Req_uirements
The following limitations and requirements are applied to board or
comrmssiorr iembership:
a. No person may serve on any one board or commission for
more that eight(8) consecutive years (two complete terms).*
In the event that an individual fills the unexpired term of a
board or commission member, that unexpired term shall not
be counted as a complete term.
b. No person will be appointed by the City Council to serve
concurrently on more than one board or commission. (This
limitation does not apply to committees deemed to be
temporary in nature.)
C. All persons appointed to, or serving on, any board or
commission shall be residents of the city of Fort Collins or the
Fort Collins Urban Growth Area. Any member who resides
outside of the Urban Growth Area during his or her term of
service on a board or commission, shall resign his or her
membership.
* Ordinance No. 47, 1991 limits members of the Water Board
to three (3) consecutive four(4)year terms.
Section 2. That the Manual,as hereby amended, shall remain in full force and effect pending
any further modifications or other action by the City Council.
Passed and adopted at a regular meeting of the City Council 7th day of
1995.
