OF THE COUNCIL OF THE CITY OF FORT COLLINS
EXTENDING THE CONTRACT WITH THE SOUTHRIDGE GOLF PROFESSIONAL
FOR TWO ADDITIONAL YEARS AS AN EXCEPTION TO THE COMPETITIVE
PROCUREMENT PROCESS
WHEREAS,the City and the SouthRidge Golf Professional,Derek M. Cordova,entered into
a Professional Services Agreement for Golf Professional Services,pursuant to a competitive Request
for Proposal ("RFP") process, which Agreement began in January, 1993, and will expire on
December 31, 1995; and
WHEREAS, the City has also entered into professional services agreements with the golf
professionals for Collindale Golf Course and for City Park Nine in 1990, pursuant to a competitive
RFP process and these agreements are also scheduled to expire on December 31, 1995; and
WHEREAS, City staff has determined, with the advice of the Golf Board, that it is not in the
City's best interest to concurrently select three golf professionals at the end of 1995; and
WHEREAS, Section 8-160 (D)(1)(b) of the City Code provides that the City may procure
professional services without a competitive process if the Purchasing Agent determines in writing
that although there exists more than one responsible source, a competitive process cannot reasonably
be used, or if used, will result in a substantially higher cost to the City, while otherwise injure the
City's financial interests or will substantially impede the City's administrative functions or the
delivery of services to the public; and
WHEREAS, the City's Purchasing Agent has determined in writing that the extension of the
City's Professional Services Agreement with the SouthRidge golf professional, Derek M. Cordova,
for an additional two years without a competitive procurement process is necessary in order to avoid
a substantial impediment to the City's administration of golfing services and to the delivery of these
services to the public; and
WHEREAS, Section 8-160 (D)(2) of the City Code requires the Purchasing Agent to submit
each determination made under subsection (D) of Section 8-160 to the City Manager who shall
approve or reject the procurement; and
WHEREAS, the Purchasing Agent has submitted his determination of the extension of the
SouthRidge golf professional's contract for an additional two years without a competitive
procurement process to the City Manager and the City Manager has approved this procurement; and
WHEREAS, Section 8-160 (D)(3) of the City Code requires the City Manager to submit
procurements which are an exception to the competitive procurement process to the City Council
when the procurement exceeds a cost of$50,000.
NOW, THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the extension of the City's Professional Services Agreement with the SouthRidge golf
professional, Derek M. Cordova, for up to two (2) additional years beginning January 1, 1996, and
ending December 31, 1997, at a cost not to exceed $53,317 in 1996, and not to exceed a cost of
$55,450 in 1997, is hereby approved as an exception to the City's competitive procurement process
under Section 8-160 (D)(1)(b) of the City Code.
