HomeMy WebLinkAbout1995-061-05/02/1995-LAGUNITAS COMPANY NATURAL AREA PURCHASE 8.5 ACRES RESOLUTION 95-61 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE PURCHASE OF APPROXIMATELY 8.5 ACRES OF LAND FOR NATURAL AREA PURPOSES WHEREAS, Lagunitas Company is the owner of approximately 8.5 acres of land located south of Prospect Street and west of Shields Street in Fort Collins, more particularly described on Exhibit "A," attached hereto and incorporated herein by this reference and referred to herein as "the Property"; and WHEREAS`,Lagunitas Company has agreed to sell the Property to the City for the amount of$253,444; and WHEREAS, one of the objectives of the Natural Areas Policy Plan as adopted by the City Council is to establish a system of publicly owned natural areas to protect the integrity of critical conservation sites, protect corridors between natural areas, preserve outstanding examples of Fort Collins' diverse natural heritage and provide a broad range of opportunities for educational, interpretive, and recreational programs to meet community needs; and WHEREAS, Resolution 94-11 established as a priority of the City the acquisition of natural area sites within the core of the City of Fort Collins; and WHEREAS, the purchase of the Property will help the City meet the objectives of the City's Natural Areas Policy Plan and will provide a unique natural area within the core of the City; and WHEREAS, in the November 1992 General Election,the citizens of the City of Fort Collins approved a one-quarter cent sales tax for the purpose of acquisition and maintenance of natural areas; and WHEREAS, sufficient funds are available and appropriated in the Natural Areas Project in the Capital Projects Fund for the acquisition of said Property, and additional funds are available in the Capital Projects Fund for maintenance of the Property following acquisition; and WHEREAS, the Council has determined that the purchase price of said property is fair and reasonable and in the best interests of the citizens of the City; and WHEREAS,the Natural Resources Advisory Board and the Parks and Recreation Board have recommended to the Council that the acquisition of the Property be completed. NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Manager and Mayor be, and hereby are, authorized to execute such documents as are necessary for the City to acquire the Property comprising approximately 8.5 acres of land, as described on Exhibit "A," for$253,444. Section 2. That the Property, while owned by the City, shall be used solely as a public natural area, and that in the event that the City Council subsequently determines that it is in the best interests of the City to sell or otherwise dispose of all or any portion of the Property, the proceeds of such sale shall be dedicated to the acquisition or maintenance of other public natural areas. A tract of land situate in the North 1/2 of Section 22, Township 7 North, Range 69 West of the Sixth P.M., City of Fort Collins, County of Larimer, State of Colorado, which, considering the North line of the Northeast 1/4 of said Section 22 as bearing S 89°34'30" E, and with all bearings contained herein relative thereto, is contained within the boundary lines which begin at a point on the boundary line of the Bridges P.U.D., First Filing which bears N 89°37'06" W 200.64 feet, and again S 09°11'49" W 461.58 feet; and again S 57°45'21" E 45.93 feet from the North 1/4 corner of said Section 22 and run thence N 35°46'19" E 9.63 feet; thence N 71° 38'48" E 92.32 feet; thence N 89°15'00" E 65.00 feet; thence S 55°00'00" E 305.00 feet to the Westerly boundary line of Prospect Greens, First Filing; thence along said Westerly boundary line S 25°00'00" E 240.00 feet; and again S 70°00'00" W 415.00 feet; and again S 00000100" E 100.00 feet; and again S 80000'00" E 250.00 feet; and again N 70000'00" E 150.00 feet; and again S 00000'00" E 190.01 feet; and again N 70°00'00" E 93.96 feet; and again S 30000'00" E 110.00 feet to the Northerly line of West Stuart Street; thence along said Northerly line along the arc of a 553.90 foot radius curve to the left a distance of 25.20 feet, the long chord of which bears S 74°23'31" W 25.19 feet; thence along the arc of a 1116.00 foot radius curve to the right a distance of 10.28 feet, the long chord of which bears S 72°53'49" W 10.28 feet; thence N 89043'56" W 653.00 feet, more or less, to the Southeast corner of the Bridges P.U.D., First Filing; thence along the Easterly line of the Bridges P.U.D., First Filing, N 01°30'21" W 705.00 feet, and again N 35°46'19" E 151.66 feet, and again N 57°45'21" W 39.07 feet to the point of beginning containing 8.480 acres more or less and being subject to all easements and rights-of-way in evidence or now of record.
